RECITALS

� 1. Since 1989 to the present, the County has been involved in a series of uninterrupted i.; •'
lawsuits involving George M. Wilkinson ("Wilkinson") and Fidelity Trust Building, Inc. � .
� ("Fidelity„).

2. One of the items in this string of litigation that is currently pending is a Motion for New
;., .
Trial in a state court case that previously had orders entered in it to dismiss all claims and
charges against the Coanty that were brought by Wilkinson and Fidelity. �r

j 3. As part of the effort to reopen this previously dismissed case, an Affidavit has been
- � prepazed and signed by former County Commissioner Fred Crowley. This Affidavit ascribes
� certain inappropriate conduct on the part of the BOCC as it relates to the BOCC's evatuation and �
, � review of previous development applications filed by Wilkinson and Fidelity.
• ; 4. In order to protect the community and defend this litigation,it is necessary for the BOCC
, . � to execute a limited waiver of its privilege to confidential attorney/client communication.
• j NOW THEREFOI2E, be it resolved that the Pitkin County Board of County
' Commissioners, of Pitkin County Colorado, hereby waives its privilege to confidential
s attorney/client communication with respect to Wilkinson and Fidelity Trust Building, Inc.
t devetopment applications for the time period January 1987 to January 1990. This time period is
� the period discussed by the Pitkin County DisVict Court's previously entered order of dismissa] +
t in case number 93-CV-11. �
i
� This Resolution and limited waiver of the attorney/client privilege does not operate to �
� } waive any other privileges to confidential communications between the BOCC and any of its �
�' legal representatives and attomeys or operate to waive the attorney/client privilege for any other
��� matters or for any other events outside of the matters and time frame specifically stated.
