1. Thomas Payne(hereafter"Applicant")has applied to the Pitkin County Board of County ,
� Commissioners(herea$er"Soard")to consider an extension of vested real properiy rights pursuant to ��'`

! 2. One non-metro area residential growth management atlocation was granted by the Board f:
i pursuant to Resolution No.9]-146 and approval of a one year GMQS extension was granted pursuant to '+'�

3. The Planning Commission granted General Submission and]041 Hazard Review approval

4. An extension of vested rights for the prior approvals was granted by Resolotion Nn.94-127.
- 5. The property is looated ofFof Emma Road,and is more specifically described in Exhibit A.
6. The Board considered the request at its regularly schedaled meeting of July 23,1997,at which ,�

time evidence and testimony was presented with respect to this application.
' 7. The Board determined that the proposed development meeu the criteria established itt Section 4- t'

NOW,THEItEFOILE,BE IT RESOLVED by the Pitkin County Board of County �
� Commissioners that it does hereby grant an extension of the vested rights for tl�e Payne property until •

j July 23,2000,subject to compliance with the following conditions of approval and the conditions of
approval as noted in Board ofCounty Commissioners Resolution No.94-127(attached as Exhibit B),
except as amended by Resolution No.95-142 and as noted below. '
