1. Pitkin County, a Colorado home-rule county, is the -
� owner, sponsor and operator of the Aspen/Pitkin County Airport •
(Sardy Fieldl , located in the vicinity of Aspen, Colorado, and has .
� the authority to regulate commercial activities and to lease and ;,
�_-;-.;,= .
license space at the Airport, pursuant to, i��r �],j.d, 1973 C.R.S. �
41-4-101 �t sea•, 30-35-202, Title IV of the Pitkin County Code, j,
and Section 8.7 of the Pitkin County Home Rule Charter; and i�:�

2. Western Pacific Airlines, a pre-signatory airline under �,�i
a Lease and Use Agreement dated December 10, 1996, and terminating
• � on December 6, 1997, allowed Mountain Air Express Inc. to operate
+ airline flights pursuant to the Agreement and under the operating
: i certificate issued to Western Pacific Airlines; and
• ( 3. Mountain Air Express Inc., now holds its own operating

� certificate and has been a satisfactory performer under the terms
? and conditions of the Agreement; and
2. At the request of Western Pacific Airlines and Mountain ��i
Air Express, Inc., Pitkin County desires to approve an assignment
of the Lease and Use Agreement for the remaining term; and
_. _j 3. On the recommendation of Staff, the BOCC finds that the s�

assignment of the Agreement is in the best interest of the County.

Agreement be terminated, subject to completion of a1Z payments and i��
