2. The applicant proposes to subdivide the 40 acre parcel into two lots to convey to Pitkin County as ���.

employee housing mitigation for the five lot Cougar Canyon Subdivision. The County may develop two ���

single-family detached,deed-restricted residences on the lots,or could sell the parcel to benefit ihe

� affordable housing fund.
. 3. The parcel is located west of Highway 82,and just north of the intersection of Juniper HiI(s Drive
� I and Upper Ranch Road,adjacent to the Brush Creek Village Subdivision and Cozy Poittt Ranch;in Sections

9,16,17,20 and 21,Township 9 South,Range 85 West,more specifically described in Exhibit A.
4. Tl�e Planning and Zoning Commission heard the application at their regularly scheduted meetings
_ on June l7,1997,and recommended approval oftlie Conceptual Submission application and recommended `
that the Board accept the parce!as employee housing mitigation for the Cougar Canyon Subdivision.
5. The Board heard this request at regulazly scheduled meetings on September 10 and September 24, .
I997,at which time evidettce and testimony was presented with respect to the application.
6. The Board finds that the applica�t lias complied with the applicabte criteria of the Land Use Code. � �
NOW TKEREFORE BE IT RESOLVED by the Board that it does hereby grant Conceptual

3. Concurrent with recording of the Final Plat for the Cougar Canyon Affordable Housing �'

'� A. Facecute and record an Avigation Fasement Agreement with the County.
, B. Covenant the land against development of more than two single family residences,whether
deed-restricted or free-market, If the residences are deed-restricted,the deed-restrictions `�
shal(be recorded by the Housing Office,based on the category determined during Detailed

� 4. Building plans for the residences shall be submitted to the Brush Creek Village Architectural 1, f'
� Committee and the Cougat Canyon Design Review Committee for review and approval prior bo �
� submission of building permits.

� 5. Prior to issuance of buiiding pertnits,the owner(s)of the tots shall:

A. Make a cash payment to thc County for school land dedication. Calculation of the payment ��
sfiali be based on Nie regulations in effect at the time of recordation. +
B. Obtain a sewage disposal permit for approval by the Environmental Healtlt Department A �� ,

D. Yards shall be kept clear of all litter,slash,and flammable debris.

from any structure.
F. Weeds aod grasses within the 10 foot perimeter shall be maintained to a height not more
than 6 inches.
' G. Firewood/wood piles sha11 be stacked on a pazallel contour a minimum of 15 feet away

H. Swimming pools shall be accessible to Fire Department vehicles.

ground tank. Any wood enclosure around the tank shall be constructed witli materials
approved for 2 hour fire-resistive construction on the exterior side of the walls. '�
