_ for the Concert for Harmony: an outdoor music and arts festival to benefit local charities on Saturday and ��� .

2. The applicants have also been authorized by Craig Stapleton to use the StapteYon property for `

� parking during Uie event.

3. The temporary use permit addresses the following:
� • Summer use of the$uttermilk ski area and Bumps restaurant,since summer use is not .
contemplated in the current Buttermilk master plan;
• Use of the Stapleton property for pazking;
� j • Vending.

" I 4. Pursuant to Section 3-200.30 of the Land Use Code,the Community Development Directar,

hereafter"Director",may permit the temporary use of land in the County for speaial events and commercial
activities,if adequate provision has been made for police supervision,if necessary;public parking;

insurance;site set-up maintenance and clean-up;emergency services;and safety of operations. !.

' ? 5. Due to the size and nature of this event,the Director opted to forward this request to the Board for !

approval. •
6. The Board considered the Applicant's request to hold a benefit at public meetings on November 19
i
and December 3,1997,at which time Ihe Board found that the ApplicanYs request meets the tequiremenGs

Use Permit for the Concert for Harmony,subject to the fotlowing conditions: ` ��

1. The Applicant shall adhere to all materiaf representations made in the application and in the public
meeting. .,-, '

2. This temporary use permit is issued for the Second Annual Cottcert for Harmony,a benefit music +-r:y.�"R.
and arts festival,which will take place from 1 l 30 am to t 0:00 pm on Saturday and Sunday,August �.:;'.:.
I and 2,1998. A maximum of'G,000 tickets may be sold for each day of the event. The pertnit is �- -'
issued from midnight on Monday prior to the event and will be in effect until midnight on Tuesday ��' ,
following the event. Music shall end by 9:00 pm on Saturday and Sunday. All trash,temporary ;`
shvctures,etc.,shall be removed by midnight on Tuesday. `s ''

3. At least six(6)weeks prior to the event(by June 19,1998),the appticant shaN provide verification �
of compliance with the following requirements to the Community Development DepartmenL
Failure to compiy with these conditions will result in revceation of the temporary use permit for the �"•

IA. The applicant shal!comply with the State of Colorado Group Gatliering Regulation,the �
� State of Co(orado Food Service Rules and Regulations,and the Pitkin Cou�ty Noise
Abatement Ordinance,as verified by t6e Environmental Healdi Departrnent. �
, � B. The Risk Manager shall review and approve the insurance for the event,including liquor
liability.
- � C. The Emergency Services Coordinator shall review and approve the safety and operations _
, plan. The plan shall require the applicant to submit a$10,000 bond for emergency
,j services.
�. _ D. The Aspen Fire Protection District shall verify that the requiremenu of.the District are
met.
F E. The CammuniYy Development staff shall review and approve a site plan showing the
�. tocation ofthe stage,concessions,first aid tent and emergency access,dumpsters,toilets,
i parking,eta
' F. Community DeveVopment,RFTA,County Engineer,West Buttermilk Homeowners t
_ ? Association,CDOT and the Colorado State Patrol shall review and approve a t
' `�. transportation,parking and traffic control plan which encourages public transportation and k
discourages automobile use. Certified flaggers or law enforcement personnel shall be hired I
� to direct traffic off of and on to Highway 82. Adequate lighting shalt be provided for the ' �
!',, flaggers. Parking control officers and attendanu shall also be hired to direct traffic into the
parking lots,to prevent cars from blocking traffic on West Buttermilk Road,and to prevent
parking in unauthorized locations(West Buttermilk Road,Tiehack Road,Owl Creek -
Road). Vehicles parking in the Buttermilk lot shall be required to arrive by aoon to
eliminate ingress/egress throughout each day. The Siapleton property shall only be used i
for pazking for service and maintenance and vehicles and for storage associated wid�the l
event;public parking shal!not be allowed on the Stapleron properry. Parking may be `
allowed at existing off-site locations(Brush Creek Road and Airpott intercept lots, `
