WITNESSETH:
WHEREAS,Jack G.and Janis G.Gausnell are the present record owners of Lots 1 r•4"
and 2,Block 4,Kistler Subdivision,as shown on the plat iiia�5 i•ecorded in Ditch Book
2A,at Page 243 of the records of the Pitkin County Clerk and Rewrder,said legal ,
description as Ueing known as 0385 Redstone Boulevard;and
WH£REAS,par�suant to Board of County Conmiissioner Ordinance NumUer 14,
Series I995,fhe property is zoned Village Cotttnteccial;and
��' } WHEREAS,Ordinance Nuruber 14,Series 1995,created a new definition of
f i Floor Ai�ea for Village Commercial zones,which allows for a 500 squai�e foot bonus in
� . floor area for properties containing a coinruerciaVresidential mix;and
WHEREAS,the requirements for obtaining the 500 square foot floor area bonus �
are that the residential living area contain at least 500 square feet of net livable floor

that the property shall be forever restricted against conversion of at least 500 square
feet of residential floor area to non-residential uses and the principal structure shall not ;

3. This covenant is created for the benefit of the Board of County
