This lease agreement is made and entered into on Yhe lst day of January, ]997 by arid � �.''
between G�eld Youth Services,and the County of Pitkin in the State of Colorado hereinafter
referred to as the"County".

Whereas,from January 1, 1997-December 31, 1997,G�eld Youth Services desires to rent an ';:....:�
office space in the Pitkin County Courthouse approximately 100 sq. feet at$16/sq ft per year # '�

Whereas,Garfield Youth Services,a non-profit agency,is providing juvenile justice services and
educational programs for high risk youth in Pitkin County. �,'

- Now therefore,in consideration of the mutual covenants and promises contained herein,the parties � .

i 1. Period of Operation: The County hereby leases and demises for the calendaz yeaz �,'�
� 1996 to G�eld Youth Services that designated office 203 in the Pitkin Counry '�
� Courthouse. Said sgace shaU be available at 8:00 a.m.,,Wednesday,January 1, 1997. :i
' i Gazfield Youth Services will be prepazed to vacate the office by 5:00 p.m.on Wednesday,
! December 31,1997,unless a new lease has been signed.
2. R�airs and Maintenance:During the period of this lease agreement Garfie]d Youth
Services shall maintain this office in good shape and repair and return it to the County in
• . substantially the same condition received normai weaz excepted. The County shall provide
- regular office cleaning Monday-Thursday.

3. Pavment: The rent for the entire term for the space rented by Garfield Youth
Services is $1,600, however, the County shall provide this amount as an in-kind
contribution.
4. Goveming Law: This lease agreement has been entered into in the State of `.
Colorado, and the validity, interpretation and legal effect of this agreement shall be �t
govemed by the laws of the State of Colorado. i
� 5. Non-Assi�nment: This lease agreement and the rights azising under it shall not be '
� assigned or transferred by Gaz6eld Youth Services.

6. Bindin¢Effect: This lease agreement shall be binding upon the parties hereto,their �;-�: .
respective heirs,successorsand assigns.

7. Miscellaneous Services: All other services,copier,etc.will be charged to
Ga�eld Youth Services at the rate determined for all tenants of the Courthouse. ���'�:?
Phones:Garfield Youth Services will make a quarterly payment to die County for - = �

significant phone bil]increases or decreases to adjust payment and Gazfield Youth :..:�;;:;'°::
Services agrees to pay or to be refunded any such adjustments. Monthly bills will ' � ��:' �

8. Gazfield Youth Services agrees to undertake its activities in the leased premises in a .
manner which will noi interfere with other tenants and activities in the building.
9. The County shall supply heating and electricity to the leased premises at no �' �.

:' 10. In the event the building or leased premises become damaged or untenantable for
= any reason dwing the term hereof,the County shall have the right to declare this lease �';�
i terminated and require G�eld Youth Services to vacate the premises,whereupon the i��

' � 11. Maintenance and cleaning shall be ihe responsibility of the County with general
� office cleaning(vacuuming and trash removal)Sunday-Thursday evening, a

12. The Company hereby releases and indemnifies the County from any liability for
i '` property loss or damage and personal or bodily injury to the property or in connection with
' . the use,storage,movement or maintenaace of the property provided that this indemnity
shall not be considered to indemnify the County from damage or injury caused by the
' wil(fu(misconduct of the County or its employees. To find indemnification,Contractor
must provide evidence of the following insurance(naming PiYkin County additionally
insured)within 10-30 days of execution of contract: �.
