THAT, for and in consideration of the sum of Ten Dollars
($10.00) in hand paid and for other good and valuable � ' . '��
considerations, the receipt and sufficiency of which are hereby � '.
acknowledged, the undersigned Howard Anton Wolny and Suzanne Marie '�`
Wolny (collectively, the "Grantors"), being the record owners of �'� •
that certain real property situated in the County oE Pitkin, State �.�. ��
of Colorado, that is described on Exhibit A hereto (the "Property") 'r"':; '
for themselves, and for their heirs, personal representatives, t;:�: �
succesaors and assigns, do hereby grant, transfer, sell, and convey
unto The Board of County Commissioners of Pitkin County, Colorado
(the "Grantee") , and its successors and assigns, forever, a '
perpetuaZ non-exclusive easement for the limited purposes described
beZow over that certain area of the Property that ex_ists along the
� j easterly and westerly banks of ttte Crystal River as it runs through
" ' the Property, between a point that is five (5) feet above the mean '.
� high water mark of the Crystal Aiver on each of said banka and the ,.
j centerline of the Crystal River as it may exist from time to time
? (the "Easement Area°) . �``'
• The Easement Area shall be used only for purposes of allowing $r
f persons to fish and conduct activities directly related to fishing, ��
. ( during daylight hours only, within the Easement Area. In no event
shall the Easement Area be used for parking, camping, picnicking,
+ campfires, cooking f%res, disposal of fish or trash, loud noises or
music and/or any activities that are not directly related to
� fishing or that extend beyond daylight hours. In no event sha].1 k
• E the foregoing grant of easement be construed oz interpreted as
• granting to any party the right to travel across Grantors' Property ��
j to gain access to the Crystal River, or to otherwise utilize any
portion of Grantors' Property except the Easement Area. �
� Grantee shaZl not suffer or permit any user of the Easement �
; Area to create noise, or to dispose of waste or garbage, or to
t: otherwise be a nuisance, in any manner of any kind or nature �
� whatsoever, to the owner of the Property. In the event that
s Grantee receives any notice £rom Grantors (or their successors and
�'• asaigns) of any violation of the terms hereo£, Grantee shall `
�`' promptly take reasonable steps to investigate and correct any such � .
� violation, including, without limitation, enforcement actions. In
� addition, Grantor shall have the right to enforce the terms of thia
: easement, including seeking injunctive relief and/ox damages as may
• be appropriate against any person who violates the terms of this
grant. ,
The foregoing grant of easement shall run with the title to
the Property. The parties hereto agree that the foregoing grant of
easement satisfies the requirement for the granting of a
fishermans' easement that is set forth in point 2(p) of that �,
certain Stipulation for Settlement and Order entered on April 28, !
1992 in Pitkin County District Court Case 91 CV 310. �; .
