WHEREAS, authority exists in the Law and Funds have been budgeted,
appropriated and otherwise made available and a sufficient unencumbered balance

� ���_� WHEREAS, the Emergency Medical Services and Prevention Programs Division .
�' (°EMSP Division") was created to administer the County Subsidy Program created by
t�� Title 25, Article 3.5, Part 6, C.R.S. ("Part 6"); and

� Wf�REAS, the Etnergency Medical Services Account within the Highway Users Tax �
Fund was created by Title Sec. 25-3.5-603,C.R.S. to fund grants for the
enhancement of emergency medical services ("EMS") statewide; and (

NOW THExEFORE, it is hereby agreed that for and in consideration of their
� ' mutual promises to each other, hereinafter stated, the parties hereto agree as
follows:
E ; 1. The Contractor must enforce the provisions of Part 3 of the EMS Act - �,.._
iicensing, inspecting, and regulation o° ambulance and other pre-hospital care "
providers to ensure that services are properly equipped, properly staffed, and j
.j '± equipment and vehicles are safe and reliable. The Contractor will require all
- licensed ambulance services to utilize the statewide emergency medical services
i i uniform prehospital care reporting system.
i ` 2. The Contractor will provide planning for the development, improvement, or
R � upgrade o£ emergency medical services_ The aforementioned plan must satis£y the .
, ( • requirements of section�25-3.5-605(c), Colorado Revised Statutes (as amended), be
y � submitted in a format approved by the EMSP Division on October 1st of each year,
S i with the first report due October 1, 1997, and any amendments to that plan must
- � be submitted by December lst of each year. The parties hereby understand and
� �� agree that the State will not be obligated to pay any funds pursuant to this
� � contract to the Contractor if the Contractor fails to submit the plan or amendment
� • E i to the plan by the dates specified above. This plan will be evaluated by the .
s ; State EMS Council, and payment of subsidy funds for the fiscal year will be
contingent upon State st�is Council approval of the plan.
� � � 3. All EMS transport providers within the County must comply with a statewide . �
data collection system in the format established by the State.

to enter into the Contract. The person or persons sigaing and executing this `

have full authorization to execute this Contract.

attachments hereto which may require continued performance or compliance beyond

7. The Contractor will comply with the Americans with Disabilities Act at all
times during the performance of this contract_ The Contractor certifies that no A.�;

programs, or activities performed by the Contractor, or be subjected to any jt. .

8. For and ia consideration of the Contractor's performaace described herein ���
the State shall pay an amouiit not to exceed $14,618.92, Fourteen Thousand Six ���1!
Hundred Eighteen dollars and Ninety 1�o Cents on January 1, 1998, and payment will ��`
be made upon the receipt of a request for payment signed by the Chairperson of the
. Board of County cortvnissioners. Such request shall be submitted in a foxm 1.
established by the State, affixm compliance with the tezms of the statute and this
contract, and be signed by an authorized representative of the Contractor. 1
Payment will be contingent upon affirmation by the EE[�775P Division of full and
satisfactory compliance with the terms of this contract Pursuant to section 25-
3.5-605(4)(a), a failure to comply with the statutory requirements of subsection
' (2) shall render the Contractor ineligible to receive moneys from the emergency
medical services account until the following January. Payment for any renewal
j period shall be on January 1 of that year, provided all reporting requirements are
complied with by October 1 of the previous year.

; 9. The Contractor is a "public entity" withia the meaning of the Colorado -
� � Governmental Immunity Act, C.R.S. 24-10-101, et sea., as amended (°ACt"), the
Contractor shall at all times during the term of this Contract maintain such �
liability insurance, by co�nercial policy or self-insurance, as is necessary to
meet its liabilities under the Act. The Contractor must provide the State with ; .
proof of such insurance.
. 10. The term of this contract begins October 1, 1997 and continues through ;�
necember 31, 1998, and is renewable at the State's option for four (4} additional 4
one year periods by Contract Renewal Letter (copy attached and by this reference f
made a part hereof as Attachment B) signed by the Contractor, the Colorado
Department of Public Health and Environment, and the State Controller or his
authorized designee. It is further understood that said Contract Renewal Letter
shall not be deemed valid until it is signed by the state Controller or his
authorized designee. Funding for any renewal period are subject to change from ��
prior contract periods based on actual funding appropriations and legislative
approval for each state fiscal year.

Aspen Valley HospitaPs medical radio system consists of several components. �
, The Emergency Dept.has a Zetron radio console that consolidates all of the radio •
channels into one operating position in the Emergency Room. Aspen Valley Nospital's �
,�' UHF medical radio system consists of Med.Channel4 and Med.Channel 10 with both �•
�; repeaters located on top of Aspen Mountain.The two channels are wire-line controlled t�
;j by the Zetron console.The HERN VHF channel is also located at the Aspen Mountain '�`
site and controlled by the Zetron console.A back-up VHF system consisting of a 16
channel radio and contro{led by the Zetron console is focated in the hospital.This

1.Fiwy.82 is a 2-fane highway and is the only direct route through the valley.The current _
traffic volume has overvvhelmed the road,resulting in daily tra�c jams that are greatly ' • '.

construction to widen it to 4 lanes from Basalt to Aspe�;this project is expected to continue
at{east thraugh the year 2000 and is making trips even fonger. �:.�`'
2.Basalt Fire District has a large rural district with an increasing popula6on in the Snowmass �` = �
Creek and Capitol Creek drainages.A flre station exists in this area with volunteer EMTs ";r "
availabfe to staff it but there is no ambufance stationed there.This results in longer
response and transport times on an increasing percentage of calls. ! `
3.Basalt Fire Dept.is currently using stretchers that are 10-15 years old and not compatible �
with the stretcher mounting systems in a�y of the other ambulances i�the county.
4.Carbondale Fire Dept.'s back-up ambulance is an old,high mileage unit that is becoming
increasing unreliable and difficult to maintain.

� extended period of time at an MCI.Our busiest season is winter and the possibility of a ski
• i lift or an aircraft accident during inclement weather is not unlikely.Some form of shelter for
� these patients,especially those not ambulatory, is necessary in order to enable us to
� provide quality,professional care for these patients.
