THIS AGREEM�NT, made as of the 1�th day of November, 1997, by and
between the County of Pitkin,Colorado,a Colorado home-rule county, chereinafter called �•� • `
the coUNTI�and TJ Concrete construction,Inc..(hereinafter calfed the CONTRACTOR). [

' WITNESSETH,that whereas the County intends to accomplish the concrete ! �`
i woric related to the Pitkin County tandfill Loading Docks and Pads, herelnafter called the `r �
! PROJECT,tn accordance with the terms antl conditions outlined in the Proposal Documents. �

NOW,THEREPORE, the County and the Contractor, for the constderations .
� hereinafter set l�orth,agree as follows:
':- � % �. THE CONTRACTOR AGREES to fumish atl the necessary labor, materials,
� . equipment, tools and services necessary to complete in a workmanllke manner all tasks
i ; required within the scope of work for the compfetion of the Pro)ect, in strict compliance �
t with the contract documents herein mentioned,which are made a part of this contract.
. ' a. CONTRACT 71ME AND uOUIDATED DAMAGES. Work under thls �
Agreement shal{ be commenced by November 12 and completed by December 31, �997.
� Contractor hereby agrees to pay County liquidated Damages in the amount of SO per
calenciar day for each day or part of a day the Project is not completed by the compleUon
r j date here established.
Ib. SUB-CONTRACTOrts. The Contractor agrees to bind every sub- ;
. E ( contractor bY the terms of the Contract Documents. The Contract Documents shail not be
� construed as creating any contractuai relationship between the sua-contractor and the �
j I County. .

i ; 2. THE CoUNTY AGREES to pay,and the Contractor agrees to accept,in full
payment for the performance of this Contract, the Contract of $2g,960.00 as further
� �� defined in section iv.of these documents,subject to increase or decrease in accordance �
4 � with the provisions of the Contract Documents. `
