This application is submitted on behalf of Aspen FM, Inc.,
as an F.C.C. Permittee for a new FM radio station in conjunction
with an application for a Special Use Permit for an additional
radio tower. Please consider this letter an application to
request a variance to vary the maximum height of twenty-eight
feet (28') permitted in the RS-30 zone district of Pitkin County
to accommodate a one hundred foot (100') radio tower.
The existing development on this Bureau of Land Management
("BLM") parcel includes a radio transmission station facility,
consisting of several transmitter buildings and antenna towers.
AT&T, the tower site property manager, has told us that the
existing antennas are bearing all the load they can handle;
therefore, a new tower must be built to accommodate the new FM
radio station. The functioning and engineering requirements of a
radio antenna requires the height and dimensions as shown on the
attached elevation drawing. As disclosed in the letter of Susan
N. Crawford (a respected telecommunications engineer), it is an
undue hardship and practical impossibility to construct a
functioning tower of any lesser height, and still maintain its
purpose. We are, therefore, seeking the minimum variance
necessary. The BLM communication site installation data form,
as completed by Denny & Associates, P.C., consulting engineers,
is also enclosed. The tower is five feet (5') wide at the base
tapering at the top to one and one-half feet (1.5') in width.

Aspen FM, Inc., permittee of KPVW, a new channe1296C3 (103.1 megahertz)
FM brondmet station at Aapon, Colorado, (Foderal Communiontione Commission (FCC)
File Number BMPH•9b0822ID), has requested a county permit to construct a now
30-meter (100-foot) overall height above ground level (AGL) antenna supporting
structure In the existing United States Bureau of Land Management communications
site on Williams Hill in Pitkia County, Colorado. The purpose of this letter is to provide
information regarding the need for a tower of the proposed height.
FM broadcast stations operate in the Very High Frequency (VIiF) portion of
the elQCtromagnetic spectrum whore signal propagation is etrict~y line of eight between
transmitter and receiver. Intervening terrain obstacles, vegetation, and foliage
attenuate the signal and either reduce or completely block receipt of the transmitted
signal. Thus, W aclueve satisfactory reception, the FM transttuttuTg antenna must be
located well above local vegetation and foliage, and, insofar as possible, above terrain
featuree in the signal path.
The FCC authorized ISPVW, four-bay, nonduectional, circularly polarized
FM transmittin¢ antenna is approximately 9 maters (30 fast) in length, and, when aide
mounted on a supporting structure, must be approximately 2 meters (6 feet) down from
the top-of the structure. Thus, the bottom bay of the KPVW transmitting antenna must
be located 11 maters (36 feet) below the top of the supporting structure. On tho
proposed IiPVW 30-meter (100-foot) supporting structure, the bottom bay of the KPVW
transmitting antenna will be approximately 19 meters (60 feet) AGL. The local
vegetation and foliage in the area of the authorized 1SYVW site are reported to be
between 18 meters (60 feet) and 24 meters (80 feet) in height, so the proposed KPVW
structure height is the minimum required for line•of--sight service to the authorized
KPVW coverage area.

need for the proposed 30-meter (100-foot) overall .height AGL tower for KPVW.

Lukes opened the meeting and introduced the Boazd.

Lukes introduced the request fora 37' Front Yazd Setback Variance where 30' is
required, a ~' West Side Yazd Setback Variance where 1 ~' is required and a 320 square
foot increase in floor azea where a maxium of 1,560 square feet is allowed, for the
construction of a detached carport in the R-30 zone district. The residence is currently
8 t 9 squaze feet over the allowed floor azea.
Schaffner stated that with the lot split in 1984 the residence is now a confomting size.
Note: Parcel is small therefore the floor azea ratio is reduced. The house has used up all
allowable square footage for any exempt garage. Request for the garage is above and
beyond the allowable FAR. The applicant reduced the proposed garage to a carport to
minimize impacts. Warren Palmer spoke on behalf of the applicant. The house was built
in 1957 before the lot split. A remodel occured after the lot split that did reduce the
original floor area. Palmer stated that when the definition of floor area was changed in the
Land Use Code in 1994 it reduced the allowable exemption for carport, or garage, if the
residence exceeded the allowed floor azea.
Letters were read for the record from neighbors Jack Crandel, Arther Greenburg and Jim
Martin in support of the variance.

the Boazd of County Commissioners for the construcfion/remodeling of a house. Rudnick

Luker introduced the request for an 3' and a 26' Front Yazd Setback Variance where 30'
is required for this 2.»9 acre lot in the AFR-10 zone district for the construction of a
restroom facility and a sunshade. repectively.
Schaffner notes the location of the pazcel in which a Fisherman~s Park will be created.
Concerns of where people will pazk was discussed.: pazking lot is located next to the
restroom. Funding will come from a Fishing Is Fun Grant. Other improvements may be
the addition of a second restroom and an identification sign.
Gem Pace and Robby, representatives, were present.

Rudnick moved to table the sunshade until the next scheduled meeting because of the

Brickham moved to approve a 26' Front Yard Setback Variance for construction of two

Luker introduced the request fora 38' Front Yazd Setback Variance, where 30' is
required for this 17.107 square foot lot in the R15 :a zone district, for the construction of
anew duplex.
Schaffner stated that this is an existing legal duplex currently used as a fourplex. She
noted the retaining wall adjacent to the roadway and the tenant's cars having to be pazked
next to the road. Johns wish is to convert the building back to a duplex with demolition of
the existing structure and construction of a new building. Approvals were received from
the Homeowners Association and Architectural Review Committee.
Richard Haberman from the Architectural Committee was present.
Luker read for the record a letter from Haberman asking for a 22' variance and a 28'
variance staircase and requesting no more cazs be pazked by the roadway. Also a letter
from Al Fiorello, an adjacent property owner, shows, for the most part, support. He
would like to see a wider space between the garages and natural sloping landscape.

Rudnick moved to approve as submitted, due to topographic hazdship, a variance of 28'
for the stairway and railings adjacent to each garage and a variance of 22' from the face
of the garage. Brickham seconded. Passed 4-0

required for this .64 acre in the R ;0 zone district, for retaining walls and a new
driveway, all of which exceed"_0 jh height.
Schaffner stated that she had received updated plans. The only correction was to an
easement crossing the property. This had received a 1041 Hazazd Review approval for the
very steep slopes and for the wildfire issue. Concerns were stressed on the retainine
walls. The 1041 Hazard Review requested that the walls be designed to retain the small
Ledge of colluvium at top of property.

to the condition of ;#2 Board of County Commissioners Resolution i#97-129. Brickham
seconded. Passed 4-0.

Lukes introduced the request fora 20' Collector Street Setback Variance, where 50' is
required from the Red Mountain Road right-of--way, for the addiion/remodel of an
existing residence.
Schaffner stated that this property came before the Boazd previously for variances on a
garage. She noted the property's location to Red Mountain Road and Wrights Road. The
existing house is in the front Yazd setback as well as in the 50' setback The proposed
addition is outside of the 30' front yard setback. A portion will encroach into the 50'
setback. Questions were asked regazding the 20' v

Lukes introduced the request fora ?2' Height Variance where a maximum of 28' is
allowed to erect a 100' tall radio antenna in the RS-30 zone district.
Schaffner clarified the location of the tower on Williams Hill. There is currently one
existing tower that is owned by Moss Enterprises (KSPI~. The FM station received
approval from the Board of County Commissioners. The BOCC requires that this tower
have multiple users. This will accomodate three more radio stations and six more pager
cell districts. The FM station will own the tower on BLM land.
