1. The county roads within Brush Creek Village are of a restricted width. For the ' ',.::,.;,r":.
most part these county roads are no more than 30 feet wide. �

hazard to pedestrians and motorists utilizing these county roads. .�'.::: `

3. This hazard is present year round when parked vehicles constrain the flow of ,«y� .
tra�c on the county roads within Brush Creek Village. 1'his problem is parricularly �;;:'�
exaspecated in the winter months with the accumularion of plowed snow on the shoulder of ' •
these roads and fhe interference with plowing operarions that parked vehicles present.

4. Prohibition of,parking is necessary immediately for the preservation oF pubtic '�- �`'�,
heatth and safety in order to avoict traffic accidents on the Brush Creek Koads. f'.: �P
+,�� 5. At the request of the Brush Creek Metcopolitan District,and in response to the ! �J
DistricYs concerns,the Board of County Commissioners is willing to enact this ordinance. �•

NOW THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Y�
' Pitkin County,Colorado,it shall be prohibited to park motor vehicles upon the roads within
the Srush Creek Village at any time.
; 1. Motor vehicles as referred to by this ordinance shall be those defined by � �`
Colorado Statute.
�
` 2. This ordinance is enacted pursuant to the county's police power as established -
� in Title 30 Articles 15 and 35,and Title 42 of Colorado Kevised Statutes. � �
� 3. Appropriate signage concerning this ordinance shall be posted along the
affected roads in Brush Creek Village.
4. The specific county roads to which this ordinance is applicable are the �

punishable by a fine of 5100.00 per violarion. The penalty assessment provisions of 16-2- '" ,
201, C.K.S. shall be followed. The penalty assessment shall also include a surcharge of ;,.
510.00 required by C.R.S.Secrion 3fl-15-402(2). ; �

6. Violarion of this,parkixlS restricrion shall be subject to immediate towing by "
any licensed towing service doing business within Pitkin Counry. �
7. This ordinance is necessary for the immediate preservaflon of the public �,:: :�
heaIth and safety, and shalt take effect immediately upon adoption after second reading, • �i- ''
