1. By adoption of Ordinance#95-14,the Board of County Commissioners -
established the Village/Con�niercial Zone Dishict, which allows a 500 square foot ���.;
bonus for sites containing a commercial/residenrial mix,p�bvided that the residential
living area contains at least 500 square feet. In order to obtain the bonus,the parcel �
� must be restiricted by a convenant against conversion of at Ieast 500 sqaare feet of the
residential floor area to non-i�esidential uses.
� ., 2. The Board of County Conuuissioners desires to sign off on any deed '
restrictions which it would be enritled to enforce.

3. Ordinance#95-14 does not establish a procedure for obtaining approval �,
of any deed restricfions. ,�?!
4. The attached covenant agreement executed by the Gausnells is the first to
. be processed under Ordinance#95-14.
5. The Board desii�es to create a streamlined process to allow for a sign-off -
of the deed restriction by the chairperson of the Board of County Commissioners after
� approval by the County Attorney's Office and the Director of Communiry Development.
• � Such a process wou(d alleviate the need for approvai of such deed restrictions by
ordinance in the future.
; WHEREFORE,be it otYiained by the Boarci of County Cominissioners of Pitldn
? County, Colorado, that the cliairman of the Board of County Commissioners may •
execute the covenant agreement between Jack G.and Janis G.Gausnell in its present g
form or any substantially simifar form; and that any fufixre covenxnt agreernents "
relaring to deed restrictions in connection with obtaining the village coinmercial
residential bonus established in Ordinance#95-14 may be executed by the chairperson `
of the Board of County Commissioners, after approva] as to form by the County
Attorney's Office and the Director of Cominunity Development,and after first obtaining !E
the signature of the applicants. �

property within Pitkin County,Colorado,(hereinafter referred to as"Owners"). • .
WITNFSSETH:
WHEItEAS,Jack G.anci Janis G.Gausnetl are the present record owners of Lots I iq';�.;:�''
- and 2,Block 4,Kistler Subdivision,as shown on the plat map recorded in Ditch Book :
2A,at Page 243 of the records of the Pitldn County Clerk and Recorder,said legal ' x�
description as being known as 0385 Redstone Soulevard;and i•`�s

WHEAEAS,pursuant to Board of County Commissioner Ordinance Number 14, f :
Series I995,the property is zoned Village Commercial;and " �
' ' WHEREAS,Ordinance Number i4,Series 1995,created a new definition of ��s
Floor Area for Village Comruercial zones,wl�ich allows for a 500 square foot bonus in '

j 1. The BOCC hereby grants to the owners of Lots I and 2,Block 4,Kistter
r Subciivision,a 500 square foot bonus of floor area to be further approved by issuance of
} Building Permit#6-903. i

� 2. By acceptance of the 500 square foot floor area bonus,the Owners agree �
that the property shall be forever restricted against conversion of at Ieast 500 square �
; feet of residenrial floor area to non-residentia!uses and the principal siructure shall not �
contain less than 500 square feet of net livable flonr area. •
3. This covenant is created for the benefit of the Board of County
Commissioners of Pitldn County and shalt run with the real property. It shali be
binding upon and inure to fhe benefit of the parties hereto and their respecrive heirs,
personal representatives,successors and assigns forever. This covenant shall not be �
