1. Pitkin County adopted the Aspen/Pitldn Energy Conservation Code in 1996. t:t'

2. Amendments to the Aspen/Pitldn Energy Conservation Code are essential in order
to maintain parity with new developments,partners,products,and techniques in the
, ., .° , npidly advancing field oFeaergy conservation.

� 3. It is the policy of the County to encourage features in any development which "
} • will conserve energy resources and mir+irr,;�e the consumprion of energy.
� 4. The amendments pmposed fiuther that policy and their adoprioa is necessary to
: _; promote the health,safety,and welfare of Pitkin County residents and visitors.
' ' S: The Board of County commissioners has the authority to adopt these amendments �
under Colocado statutory and constitutional law,including,but not limited to,Colorado.
� � Revised Statutes Title 30,Articles 11,28,and 35. �

i ,>. County Commissioners ihat it hereby amends Title VII of the Pitkin County Code-

' Buildings shall be designed and built to comply with the requirements of
the 1997 Aspen/Pitkin Energy Conservation Code,as amended and
j incorporated by this reference.
� 2. Upon the effective date of tkris Ordinance the 1996 Aspen/Pitkia Energy
iConservatioa Code shall no longer be in effect� '='

3. Copies of the 1997 Aspen/Pitkin Energy Conservation Code shall be retained at �'=
� the Community Development Departme�,Building Division and.shall be available for -t:, .
review or purchase by any member of the public. '-•:"�

Section 103.2 of the 1997 Aspen/Pitkin Energy Conservation Code provides:A , ,
violation of any of the provisions of the Aspen/Pitfan Energy Conservation Code shaU ��:,'� ;
consiitute a misdemeanor,punishable upon conviction by a fine aot exceeding six s `;�:,�
hundred dollars($600.00),or hy imprisonment not exceeding ninety(90)days,or both -
such fine and imprisonment A sepazate offense shall be deemed committed oa each day 4
' or portion thereof that the violation of any of the pmvisions of the Aspen/Pitkin Energy �� .
: Conservation Code occurs or continues unabated after the time the limit set for abatement -
