RECITALS
y'" .
1. In 1988 the County undertook the reconstruction of a poRion of Red Mountain '
- Road in the vicinity of Lone Pine Road.
2. As part of this reconswction project there was an agreement to exchange
� - properties to acquire an additional right of way along Red Mountain Road to accommodate the
�t new constructian. The current owner of the exchange property is the Tercero Corporation.
�
j 3. For reasons beyond the control of all the parties involved,the proposed Iand
exchange was never executed,even though the Coanty d'ed complete the reconstruction of Red
• Mountain Road using the property to be conveyed by Tercero,pursuant to a construction license
;
agreement with the then owner.
, - 4. It is stiil the desire of the County and Tercero to complete the exchange of
properties by quit claim deeds.as attached as Exhibits A and B.The legal descriptions of the
properties to be exchanged are contained within the deeds. �
NOW THEREFORE IT IS IiEREBY ORDAINED,that the Board of County
j '' Commissioners of Pitkin County,Colorado authorizes the chairman to execute the necessary
documents in order to complete the land exchange between Pitkin County and the Tercero
' Corporation by executing the quit claim deed in substantially the same form as attached in
; ' Exhibit A,and causing the same to be delivered to Tercero at the same time that Tercero delivers
j an original fully executed deed to the County in substantially the form attached as Exhibit B,and
r ;, to execute such further documents as may be necessary to complete the transaction
