Pi1Ri.TC COMMENT• Tom Stevens appeared before the Board to request an expedited review for the Aspen Schoo! District affordable housing project in the Woody Creek area. He explained that the land is being ` idonated by Aspen Valiey Ranch to the Aspen School District and all the consaltants on the i project are working at significant reduced rates so they can get teachers in the houses as quickly as possible. He explained that the project consists of 10 units/five duplex structures with a mix i of RO and Category 4 units with one free market lot. t • i Commission members agreed to give this application agenda priority by scheduling special meetings. A F - ! copy of Ms.TurnbulPs letter is attached tiereto and made a part of this record as EXH�IT"B". � , Mary Lackner said that with respect to the Division of Wi1d(ife maps,these are maps that the j � Division of Wildtife gces out and looks at wildlife habitat every five or six years;ihey create � new maps and make those availabie to counties who have adopted iO4i regulations. She � � explained tUat the existing maps which were being used were adopted in 1991. The DOW . f t resurveyed a lot of new wildlife habitats end created new maps. She noteQ that there is not cost associated with these maps to tl�e County,and maps are complete. � i i ' ' With respect to the wildfire maps,Lackner said this is something that the State Forest Service * : requires funding from the County to produce wiidfire maps. She explained that they have a grant 5 �` ' progrem that has been applied for and the County has received a matching grant to map new i - areas. She said the State is in the process of remapping some of the lower Roazing Fork Valley; � ! ? which will finish wildfire mapping for the Covnty on the majority of private lands, � � � Lackner said[toz's letter is correct in that we will have different resources for wildfire mapping; � S using maps from different dates,until this year's grant is finished because we will not be getting ; a product from the State Forest Service until December 1 st. She said what couid be done in the meantime,is have an overlay map of the whole County and shade in areas to depict which maps ; should be used either 1996 maps,1991 maps or the 1974 maps. � I' After a discussion,it was thc consensus of Board members that they should go forward and ! adopt tliese maps at tl�is time,thereby,having morc current information avaitable to the public. � Commisseoner Harper moved approval of first reading of the Ordinance and set for second . reading on May 14,1997. The Huffman parcel is 160 acre tract where if they were to take a �y� , ; GMQS approach,there could be as many as five lots up there. Grace Huffman chose to do � s:.; �� instead,a 50%reduction lot split,which allows for two lots on 160 acre tract in order to be able ,y. to create the ability to sell one lot to protect the balance of the land for her estate. Lot A has a `�;� 1041 approval and the 50°/n density lot split approach was also approved. Ms.Huffman would �,� like to seti Lot A,which is not subject to any easements that are problematic and is retaining Lot - B for the family estate which does have die need for these easements to be recorded and so forth. He thinks the concern of staff was that Lot B coutd be sold to an unsuspecting person with these easements hanging out there that may or may not be problematic to achieve. And so in the • interest of protecting an altimate consumer,have suggested that all of Utis occur prior to the * recordation of the plat. Young said what the applicant would like to see is,while they believe � those easements are forth coming,they would like to see U�at any further approvaf,which parcel B would need,that prior to a 1041 approval on Lot B that those easemenYS be recorded. In their � opinion,that would protect any Qotential buyer. Lance Clarke said there exists right now,on the Fathering parcel,a smal(cabin that the Huffmans 'i � utilize in good weather. And they were not suggesting that any changes be made to it at this time j so staff did not do any]041 review on tfiat site. The condition says that if there are to be any ; changes or additions to that cahin,they would have to go Uirough 1041 review. In putting together tlie Resolution for the final approval,which is now,the County Attorney suggested that � we should have timing on when we need those easements,and it was suggested that they should happen now;at tlie time of the recorded plat. He said their concern is that the Huffmans could ? seli the property where the cabin is and someone,other than the Huffmans could use that cabin � i without coming through any further reviews. Therefore,their concern was someone might buy it without having the appropriate easements. Mr.Young said they are not objecting to fanguage on the plat that suggests that this easement needs to be recorded at the appropriate tima. He said the Forest Service has never objected and has in principal, agreed that an easement is possible. They have operated on a good neighbor �: :ir:_�,..;%: poficy all these years,as many people have,and both realize that these easements need to forth ; .� come. Similarly,the Maurins need a Forest Service easement in order to consummate a sale on that 360 acre parcel. He said his clients are anxious to get the easements because they are anxious to sale Lot A. He explained that there is no problem getting an easement over the Maurin property. � Cindy Houben,Community Development Director,said the fundamental element of subdivision . . i � is access. Even though tfiis is a lot split,and a shorter subdivision process,a lot is still being icreated. Also,all the subdivision reviews that have ever been done,especially when Forest ?�, � Service access is involved,it always been a condition of approval that there has to be access ;�� throug6 either a permit from tlie Forest Service or something of that nature. She said she can't j think of a case where a lot has been created knowingfy without access. �� . , Mr.Young reiterated that they feel they have U�e access,and he does not believe the Forest ! Service has suggested that they don't. As part of this application,they have agreed that forever and a day there will be an easement by tlte public to the public lands. ; Deb6ie Quinn,Assistant Counry Attorney,urged the Board to require that the easements to be in I;';:i_ Iplace prior to Final plat being recarded. She pointed out that this specific condition was in the ' � Resolution for Conceptual approval last August. � Commissioner Farris suggested that there be a condition placed on the plat so that anybody ' interested in buying Parcel A would have notice of that. � � Mr.Young said they would agree to such a condition. � A discussion ensued with regard to this issue. � Commissioner Lamont suggested that tl�e resolution be approved with the condition as written. • g However,if Mrs.Huffman has a potential buyer then she would be wil(ing to entertain the issue i again by considering a minor plat amendment. � ; Commissioner Lamont moved to kee�CondiNou No.20 and then add langu8ge that the ' applicant has the ability to request a minor plat amendment if acquiring the easements f become a problem. The onty � area that can be construed as having any wildfire hazard,is the 20 or 30 foot band in between the ! riparian area and the river. Rather than require them to re-rooF right rtow,he would ask Yhe board to consider only requiring the cabin to be re-roofed if and when iYs expanded. With respect to the satellite dish in the easement,what he originally proposed was to move the ' � easement to match iY up with the alignment of the road,but staff pointed out that it was already ; jDenver&Rio Grande right-of-way. The comp(ication with that � is ihere is a privaYe road easement on the other side and an existing gravel road over there. In this case,Uie properly does have at least the electricity and phone service already attached. She said it was ajudgment call, � � COmmissioner Ireland referred to Criteria No.2. He questioned if the argument was that the emergency services isn't difficult because there are other places that are not in rural and remote,that Imve equally di�cult emergency service. He said he doesn't understand this - because either the service is di�cult there or it is not. Ms Houben explained that she thinks ihey were giving the benefit of the doubt here to the applicant,because of the current situation that that road is plowed to access her property. In many cases,in the rural and remote zone district there is not that situation. _ i Commissioner Ireland said it seems to him that emergency service there is difficult.He emphasized tfiat he t6inks the emergency service here is clearty ditficult. 1 , Commissioner Furis referred to Criteria No.9. So if they can get this type of trailer up there she is sure they can get a fire truck up there. The Dart Property is unique in that its preservation in essentially the undeveloped � • state in which it has existed for the past fifiy or more years will protect lands identified by ' ;:. the Open Space program as primary in their need for preservation. These categories :' indude the preservation of critical wiidlife habitat (the Dart property is almost entirely �Yr. mapped as critical elk and deer winter range),sensitive ecological lands(the almost one `�� mile of rive�front contains some of the highest quality aquatic habitat on the entire Roaring ! Foric River, according to the DOW's aquatic biologists, and the riparian areas along the j . : river are extremety important to many species of wildlife, and thus are important to preserve), the preservation of open space corridors (the en6re property is visible from > Highway 82 and is the last large undeveloped piece of private property along this stretch of the River and the Highway),and the preservation of historic agricultural operations(the properiy has an agricultural property ta�c identification based upon its history of cul6vation and domestic livestock grazing). Furthermore,the Dart family has offered several signficant opportunities for pubtic �,�. access, something which is very rare in a conservation easement, but something the Open Space Board feels is critical to acquire whenever possible. These accesses include making permanent the existing managed public fishing access to the Roaring Fork River, providing hunters access to the BLM lands known as Williams Hill, providing . access to the historic WheaUey Cemetery, providing access to adjacent public lands r through Wheatley Gulch and providing a non-commercial kayak and raft resting/picnic ' � point along the Roaring Fork River. None of these public access points will be available until actually developed by the Open Space program, with the exception of the existing managed fishing access. • The Rocky Mountain Elk Foundation is contribu6ng$20,000 to the purchase of the Conservation Easement based upon their belief that the property is critical to preserving elk habitat.
