A discussion ensued with regard to the issue of a instance of a non working woman who has �.', donated her time to the community,qualifying the same as a working woman. � ' � Mr.Tolen explained that in addition to be qualified,if you are a former worker who is retired, i they would also be qualified if they are the spouse of a former working resident. He said there are sevecal instances where this has happened. Also,there are instances in divorce situations. However,he wants to be clear that what is being taiked about are workers in Pitkin County he is not talking about folks who have lived in ot6er areas and retired here. He said as a community, the community might want to create a senior housing program that may be a difFerent program than the housing pmgram for working residents. A discussion ensued with respect to enforcement. Commissioner Lamont suggested a joint meeting between with the Ciry Coenci!and the Housing Authority Board to discuss enforcement because she would like to hear what the Housing Board's perspective is on ffiis is. � Chairman Tuite opened the hearing to public commenf. Phoebe Ryerson expressed a concern with respect to not having a house sitting possibility for a lot of the young workers in town. •�� r. However,in 1990,the K= Ciry of Aspen and then Pitkin County followed suit,with an accessory dwelling uniUcaretaker :y��`,::: unit program where now it is legal and it is encouraged for people Yo come. She said in fact in , . '. the City,it is mandated for all new homes. j:`: ,• Commissioner Farris reiterated her comments from the previous meeting with preferential ,� � treatment for emergency personnel of other quasi�ovemmental groups that are supported by a �' `f tax base. She said she would also like to promote a program which would,for incentives for • Y' buiiders,to utilize solar,wind power,or altemative building materials. ���,>. Mr.Tolen suggested that this is another good issue to talk about jointly because the Housing � •'. Board have had specific requests from teachers and hospital workers. And some requests have � been granfed such as the Moore property. � �Y � e � Commissioner Ireland said he would like to raise the issue of�ffordabfe affordable housing. Commissioner Iretand moved to adopt the Housing Authority Guidelines with further discussion with the Housing Authority. Commissioner Farris seconded the motion. MoUon passed unanimously. This ; house is three bedrooms;a master and two over the garage. Everything in this house is just �, slightly out of our code. It has an extra 190 feet so it can not be a caretaker unit. She said what ' is bothering her,is that any reasonable person,who looks at this says,this is a single family dwelling. R� Chairman Tuite said he is going to vote against this but he thinks that staff should be directed to schedule discussion with the Board and see if we want ro address this in a different manner, 's Debbie Quinn,Assistant County Attorney,recommended to the Board that the application be - denied due to the fact that it does not comply with the existing code because this is something that can be used for residential purposes. Not that it is intended to be used for residential purposes and if the Board wants to change the language of the code,an appeal is not the process j . to do thah,that needs to be done through the legislative process not through an zppeal. Secondly, � she said with respect to the hardship issue,the code does not providc for appeals on a hardship to this Board. She said there is also a sloping hillside on most of 99A which makes a difference. He said this all got started through some surrounding complaints regarding activities at the BRB which primazily those complaints centered on length of tenancy in the campground by RY's and trailers. He proceeded with a presentation associated with the background,existing inventory and issues associated with this matter as outlined in the memorandum. A copy of this memorandum including two memos from the Environmental Health Department,is attached hereto and made a part of this record as EXFiIBIT°`K". Clarke clarified that the underground pool,listed in the inventory sectiort,is actually an above ground pool. Secondly,staff has no problem with the signage that exists. He said the one thing ; that the pianning staff and the environmental health staff is concerned about is that the septic system is not of sufficient capacity to deal with these uses that are on the property, He said the purpose of this meeting is to make a recommendation to the Board and get something adopted as to what are all of the uses that we are going to allow there and wtiat will the owner do in order to bring the septic systems into con£ormance as quickly as possible. He referred to the list of legal non-conforming uses and structures on page 3 of the memorandum. He said staff 6as no concern i with these items. Staff thinks the site can handle them and iYs reasonable to allow those uses to , continue if the septic system cao be upgraded to provide the capacity needed for all of t6ose r uses. He said the major concern that staff has and some of the surrounding residences have,is � tl�e occupancy/tenancy both of the RV sites and the cabins. With respect to the satellite dish issue �`'.;: he thinks it is 100 feet from the highway. Mr.Feigenbaum said that two or three people mentioned that the cabins were historically rented � , � for six months or so for the winter and then either daily,bi-weekly or some other standard throughout the year. He knows that prior to 1975 ihere was not 20 RV's spots because t there was probably not 20 RV's in the State of Colorado;the RV is a relatively new invention. � He said if the campsites were reduced from 53 to 35 or something therc would be enough room t to make a nice park,and that would probably be closer to what was going on in 1975.
