'�':;^` He proceeded to review a site plan reflecting the proposed driveway. He said as part of their ':i�.:,' . proposal,they would go into the existing driveway,which goes straight up the ride and Y�' . revegetate it and return it to a natural state.He stated that there is only 320 lineal feet of disturbance on slopes over 30 percent. He said it is trees all the way,with the exception of one � ,�� area that goes approximately 200£eet out of the trees. Also,the driveway will be constnzcted to > County Road Standards of 12 foot wide with some pull-outs. � Mr.Horn proceeded to discuss the issues of wildlife and wildfire as outlined in his proposal He stated that there are no issues associated with these two items. ci: W ith respect to the visual impacts of the house,there is no doubt that it would be visually obhvsive for people going up the West Buttermilk Road. Therefore,they wou(d commit to a - - design for the existing site that would have just one story on the top of the ridge and tlien back off to the east down the hill where the building can be sheltered,given the grade. He said they checked the site from Owl Creek Road and from Highway 82,and the site cannot be seen. He reiterated that they would limit it to whatever one story would be and if the Board wants to see a �. a design,they will do a design;in addition they would commit to a landscaping plan. Commissioner Harper questioned why the applicants p�eked this particular site? Z Mr.Hom responded that there are iwo reasons: spectacular views and ski in and ski out access. He stated that if this application is denied,they will be looking at the full development of the property through the Growth Management System. He reiterated that he thinks the legislation 1 that is in place,creates the capability to make exceptions for minor instances like this where you � '�� ' ' cross slopes over 30 percent. He referred to an application that was approved before the new regulations,that bei»g Hawk Greenwood's cabin. He said the tradeoff[iere was definitely visual versus slopes and wildfire. He said the house has been built and no one sees it. - = And he thinks the County,the public and the property owner wins in that situation by being �'� '� flexible and trading offone goal and objective against anothec '�:.` Mr.Horn summarized that he tliinks the$oard has to consider trading off the goals and �,;.:�,..�`�. objectives. The fact that this is an 80 acre parcel and building a long driveway on a property that !' '� is 80 acres in size should not be a major concern to the County;particularly when no one will see (k"� it. There is the issue of the future development of diis property through the Growth Management ��` " Quota System,there is the issues of the affordable housing unit,which will still be constructed, � ' f'..,' the fact that the slopes are going to be disturbed are primarily 30 and 32 percent and only 320 !,i ' feet of a 3200 foot drive crosses those slopes,the consideration of the existing driveway,which �; is vety unsightly,will be revegetated,plus the erosion problems that would be corrected `+:'`' represents a tradeoff both for the county and for Art and he thinks it is in the public interest and ��, ` well as the private interest io approve this request. Also,he said they would commit to a ' �:;� landscape plan,for review by the County,for stabilization of tliat slope and corcect the eroding i� situation. � �',.,� Mr.PSster pointed out that he is trying to get some money out of this lot, But if tliey can't get {�� the new buitding envelope then they wil!have to go back through the Growth Management Plan. j • He said the reason this lot is worth the money is because it is ski in and ski out;there are no other lot where the runs can be accessed. i Commissioner Tuite asked Mr.Horn what height restriction they would be offering with a one - ' story house7 i , Mr.Horn responded that it would be approximately 12 to 16 feet high,but they would be willing � to work with the potential buyer of the Iot,and bring in a design p(an for the$oard's review. Cindy Houben,Community Development Director,said the comparison with Hawk Greenway's � cabin is somewhat irrelevant in the sense that there was no other place to go on that site,and � relative to 1041 concerns,there are other locations on this site. _ Commissioner Harper asked what the concerns of the P&Z were with respect to this road? Lance Clarke responded that they did not feel that the intent of that ordinance was for this kind o£3200 foot driveway. They thought it was true anomaly of a situation to avoid takings and that 1 ' kind of thing. , 'w� Chairman Tuite said he does not think they put this into legislation to necessarily avoid a takings;there were other issues. i Commissioner Lamont said her thought was that in those instances when you did not have other �� ` options,and we were really precluding things by minor small portions of 30 percent slopes,we '��, - were not giving ourselves the creativity and the flexibility to get out of a bad situation,neither � � ' were we giving the applicant the creativity. There is little opportunity to utilize this existing access in any way as it is steep and on the ridge line. This access should be stabilized and revegetated. - We have surveyed and designed a new 12°/a driveway from the existing entry raad to the West Buttermilk Ski Lift parking lot to the existing pfister cabin above ihe West Buttermi(k base area. The driveway is#3200 lineal feet. The general aspect of the driveway is a north ; facing 25°�slope area. Elevations range from 6004 feet to 9264 feet. i A majority of the driveway lies on 7ract 3,however, t 800 linsal feet of driveway lies on the t adjacent Tract 5. An easement witl be necessary to construct this portion of the driveway.
