After a discussion,it was agreed that Mr.Pettet would speak with the homeowners with respect to

County Attomey,said as a result of a work session with the Shield O Mesa Homeowners,the .���.
Board ditected the attorney's office to prepare a resolution that would acknowledge that the Board
• will be requiring properfy owners,who do not voluntarily join tUe road association,to conform to
join in connection with obtaining any 6uilding permit or land use approval from the County. This
resolution was drafted by Cindy Houben and herself,and they recommend that the Board pass it as

Brooke Peterson,Attorney for the lender,stated that he has two amendments to the resolution. '' �i
First it is not a pro-rata share,because the association has come up with a formula that is not pro- '�
- rata. Secondly,the association is requiring everybody to adopt or place upon their property cectain j
protective covenants which assure the association's on-going ability to collect assessments.
T'herefore,he thinks the resolution should reference the fact that not only should these people be ;
required to join the association,but should be requi�d to accept those protective covenants and
have them placed upon their property. Lastly,if a road improvement district is ever fottned out in
that area,this resolution should say that a person getting a land use approval has to join that road
improvement district. For housekeeping purposes,Mr.Peterson noted that the name of the road
� should be"Shie(d O Mesa Road"as opposed to Shield O Koad.
i Commissioner Ireland suggested an amendment to the last sentence on Page 2 to say"Requested
j from the County,and to pay a share of the initiat improvements as provided in the restrictive
covenant. Further,the property owners must accept the protective covenants as a deed restriction
i running with their lend and must join a road improvement district,if ona is formed by the
� association."
David Hale,a member of the association,requested that the language state"Shield O Mesa Road
improvements and on-going maintenance."
Mr.Peterson said rather than saying the formula as set forth in the covenants say"The farmula as .
determined by the association." !

Commissioner Lamont said she agrees with Commissioner Ireland. Sha acknowledged that there
is a letter in the packet from Glen Hartman,but she was surprised that Uiere was not more of a �?'�' '�^

" said tfiat the big problem they have is that currently the land use code does not contemplate or
enable preservation or resYOration of the historic sVuctures. And they have been struggling for the
� last I S months with staff and the P&Z to find the appropriate vehicle by which do that. He noted ''
that the first direction by the Board afCounty Commissioners,was to create a historic zone
� district. They tried that 6y working wit6 staff;but it seemed to create more problems tl�an it
served by having to go in and rezone. Therefore,they came up with current proposal,which is to
_ � do an overlay rather than a rezoning wherever they have a historic structure. So he thinks one of
� the threshotd questions for the Board of County Commissioners,is whether or not it is more
j appropriate to take a historic parcel,rezone it historic,and al(ow appropriate uses or to use a
scenic overlay to come up with a way to control development and restoration of historic structures. .

With respect to the bike path,they would suggest that the path be re-routed behind the buildings to
improve safety for pedestrians and bikers. He said the neighbors have pointed out that t6ere are a
lot of kids,during the winter,that use that path as a way to get to schools in Basalt. And they are
sensitive to t6at issue and improving that feature of die property. In addition as a side issue,now
that the County owns the rail corridor,the CDOT argument that it is impossible to shift the road
towards 8�e railroad could be looked at again as part of the improvements that would be funded to
those intersections. If this development is approved,thm the restriping and recountouring of that �
road could occur on the far side,using the existing asphatt as acceleration/deceleration lanes, �, '
rather than a through traffic lane. He said there are five single family homes adjacent to the west
and a large wettands and beaver pond that would remain as part of the fad�ering residential pazcel.
They have shown on their plan access to that and tliey l�ave been including some trail mitigation, i '
improving the bike path and some of those issues. He proceeded to review the history of the site �; , -
with commission members. He said what they are asking for is a rahabilitation of old commercial =�:
structures and usc them as d�ey have be used historically;this is not a good site for residential �'
living due to the close proximity to the highway. He proceeded with an argument as to why they � t

What is going to generate more deliveries is people moving into the area. The biggest impact that i

implement a mail route out of Woody Creek. As far as the traffic gces,the tavem connected to her
is a total nightmare. People run into each other all the time and she has elderly people fighting
with bicycles out in the parking lot. In addition,it is very difficult for the mail truck to make
deliveries when they are in competition with delivety trucks for the tavern. As far as the location
� ' they have chosen,what she had heard from the people who live there is actually acceptable. In
, order to get tlie Woody Creek people,caucus and residents to all agree on someH�ing is a miracle.
! ]ackie Lotliian,representing the Woody Geek Caucus Homeowners Association,said they have
i a!1 supported the post office in their effort to keep the post office in Woody Creek and not have it
I taken away. The only option is for the post office to go to another place. The current landlord has

next door or expand the post office any place on that site,

2.)Clean and seal the brick with miradri.Contract to be negotiated with a roofing .
contractor.Appro�cimate cost$6,000.00 plus possibility of a mason to skim coat wall
$1,000.00.
3.)Radon mitigation.Contracting witii original contractor to perform furiher radon
mitigation and tie into existing system.Cost$3,200.00.
FYI: We will be doing a public notice of the project in the daily newspaper and notifying
the tenants of the building.Tt was part of the ITB spec�cations that the contractor work
with the courts to schedule the work.
• We wotked with the City Pazks Department to get a pmcedure to be followed to
minimize the risk to the four pine trees at the two front comers.Every precaution will be
taken to save the trees.

About sixty-five sNdents devoted thirty hours of classroom time to complete a
, three credit hour course at CMC. Ali passed the B.E.3.T.requirements incorporated in ��'�
Sr.ctions 6-4 thraugh 6-9(pages 3,4 and 5)as commereial or residential buiiders.The �
CMC ciasses provided an opportunity to discuss code applica6on to actual construction �'
situations. An unexpected benefit of this classroom interaction has been to formalize a ��
Building Division policy booklet to maintain consistency in our code application
decisions. ��

� In 1996,$51,557 was generated from contractor licenses,pro-rated fees,renewal •�
; fees and test fees. This compares to$38,386 collected ia 1995 for the same items. The
; fee schedule is on page 7 of the ordinance. I expect this sharp increase to flatten as newly
� iicensed contractors renew yeazly aY a lesser fee. The iicense and rettewal fees increased .
; 4%to reflect infla[ion. The test fees remain unchanged.
' The Owner/builder iicense category,addressed and defined in Section 6-3(b)on
page 3 of the ordinance,reftect a dramatic decrease in pemvt issuance. In 1995,seventy
eight permits were issued to untested owners and itt 1996,thirry tluee permits were �:'
+ issued.This is an expected outcome and desire of che licensing regulation. No"licensing
or test"fee is collected from the Owner/builder.

Description of Issue: Pursuant to state statutory[aw,the Board of -
County Commissioners of each Counry is required to review requests and applicarions
for licenses made by individuals or corporate entiries seeking to provide ambulance �. ..
service for the public. All ambulance providers within the state must be licensed by the '�
, BOCC for the county in which the provider is based. Although based and licensed in
; ��';
` one county,the Piotder of a valid ambulance service license may provide that service in i, .
� any locarion in the state. State statute provides minimum requirements for the issuance !�!�
of an ambulance service license. The BOCC of each county may increase those �::;�
statutory minimutns. Prior actions of the Board establishing licensing criteria have ''�
been made upon the recommendation of the Emergency Medical Services Council. The �,�'
Council is a volunteer board comprised of inembers of the communiry working with �
ambulance service providers. The EMS Councit has recommended changes to the ;
� + current licensing requirements which are included as part of the proposed ordinance �
� for the Board's consideration.
Additionally,in the past,the EMS Councit has worked under the public safety �
a council as that bady was constituted through the Sheriff's Department. It is the desire
of the EMS Council to work directly with and make recommendarions directly to the
. BOCC. This change in status is incorporaEed in the proposed ordinance.
Due to the legal ability of any licensed ambulance service to provide such
service in Pitkin County regardless what county issued the ambulance license,specific
; concerns relating to the character and physical environment of Pitkin County might not
be addressed or required by licensed providers doing btxsiness in Pitldn County. y
� Consequently,the EMS CounciI has concerns for the adequacy of ambulance service
i providers licensed outside of Pitkin County who are providing a service in Pitldit
; County in connection with a special evenf. As a result,the EMS Council is reyuesting
that the BOCC direct the Community Development Office to refer applications for
� special events permits to them for review and for the BOCC to consider their
recommendations for the qualifications of arnbulance service providers attending
� special events within the county. ,

In a preliminary review of the proposed site plan and bculding alterations,there are some �
' areas which warrant discvssion. I recommend that the desi�n review issues be addressed ��. �
� in "Steps 3-5" of the five step review process, following evaluation of the land uses
� proposed in�eneral. �
I find this proposal to be an escellent, opportturity for the County to become more
� involved in ensuring the preservation of our historic resources while providing an
appropriate incentive for the property owner. The Emma Store site has been determined I
• eHgibie for the Nariona!Register. It is a very significant and highly visible resource and ,` �!, '
a true landmazk along the Highway 82 corridor. The properiy has been dramarically
� unpacted by the widening of the toadway and has also deteriotated from Iong-term
vacancy. The Counry has declared historic preservation a prioriry by adoption of the '
1041 rewlations and should act to create incentives which make preservation viable. In �;i,� `
the case of Emma,this requires allowing some income producing use of the property to

question. The traffic coming from Basalt along this stretch of highway is very heavy in peak hours,and � '

In addition,once traffic leaves the light in Basalt,cars generaliy speed up to 65 mph between Basalt and ,�
Emma,even though the speed limit in this area remains at 55 mph or less. This may be due to the
! State's recent increase of the speed limit to 65 mph near El Jebel or just the availability of fow lanes to
� ; use after the long two-lane drive from Aspen. Whatever the reason,traffic speed is fairly rapid at this
f point. Because of this,even though ihere is a left turn lane near these buildings,it is often dif5cult to
� make heading downvalley untess one starts out from the Basalt light in the left lane(passing lane). It is

also difficult to pu11 out of the Emma/Sopris Creek area onto Highway 82 heading toward EI Jebel,due
` to the trafTic volume and speed coming from Basalt up the hill and around the corner at the Thomas �
�
property.
I hope this letter helps describe the traf�c situation as it currently exists at the Emma turn. Guven the
curve and topography at tha area,together with the angle of the sun at sunset(peak trafiic time)and the �
limited night time visibility(there are no sYreet lights in the area),I strongly request you deny any
commercial use in this area.

STAFF COD'IIVIENTS: The Land Use Code Section 3-80.50(C)(2)(attached)shictly prohibits ���
development on slopes in excess of 30%.The rigid nature of the cuirent Code has,in certain cases, 7
- limited the ability of Staff and the Boazd to apply professional judgment where development is
proposed on slopes of limited duration in excess of 30%,nor does the Code atlow any discretion to :
allow any deveiopment on slopes in escess of 30%in order to prevent or reduce the impacts of the
development on other,perhaps more sensirive,environmental areas.
The primary direction of the 1041 Hazard Review legislation in the Code is to guide development '
away&om hazard areas. The Code does in certain situarions atlow developinent to occur when site
planning and engineering techniques can"completely mitigate hazards to public health,safety and
' welfare". This is perhaps the basis to consider an amendment to the Land Use Code which
j provides specific criteria regazding proposals for development on 30%slopes of limited duratiori
j and impacts. The adoption of specific criteria may provide the BOCC with,a way to avoid
; unnecessary "takings" procedures and also give the Applicant a determinatioq with respect to � �
idevelopment on slopes,at the begauung rather than later in the land use pmcess. ,

STAFF CONIlVIENTS: The Aspen Fire Protection District(AFPD)and the U.S.Postal Service
(LTSPS)request County approval to construct a fire station and a Post Office. The applicants
propose to create a new one acre lot to support these uses. These requests require that the
property be rezoned to the Public(PUB)zone district which allows these types of uses;Growth
Management Exemptions for Essential Community Facilities to mitigate unpacts;and a
Subdivision Exemption for Essential Community Facilities to subdivide a one acre lot. The

The e�cisting 60 foot wide Upper River Road easement appears to run through the Mobile Home
Pazk. If that easement were moved to match the existing road it is unlikely that the Post Office
could use the proposed location. 1

application;however,that approval was condi$oned on receipt of an acceptable traffic impact ;�
