Attomey,explained that the only change from first reading is a change in Paragraph 5 of the
Ordinance that changes the penaity for a vioiation from what was$600 per viotation ta$100 per '
1 violation. Other than that,she said the Ordinance is the same as the Board reviewed at first ;
' reading.

; Jim Crowley,representiog the Brush Creek Homeowners,explained that the Ordinance
' ! Prohibitiag Parking on Brush Creek Roads is for first of all safery purposes. Secondly because
they do p�ow the roads and they cannot do it effectively if there is a car ort the road. He said the
j County has the responsibility for p(owing tfie roads,and the County has subcontracted the ;
� responsibility to the Brush Creek Metro District. They in turn,contract the work out to a
i snowplowing husiness.

i Commissioner Ireland asked Mr.Crowley how they would deal with an instance when someone ��
� has a party nnd cars have no where else Io park. �
Mr.Crowley responded that if someone is having a party and is creating a safety hazard,there ;�
� has to be a remedy for that He said over the past winter there has probably on(y been an i�
� instance wlien they would have had to tow three or four cars. �
! Commissioner ireland suggested that in the instance of someone moving in the subdivision and
� not knowing that there is an ordinance prohibiting parking on the street,that d�ere should be a �
� sticker placed on the car saying that it is the subject of being towed prior to actnally having it
' towed.

± Commissioner Tuite asked that this be qualified as a recital in the Ordinance that it is at

Commissioner Harper moved approval of second reading of the Ordinance as amended. ,.
Commiasioner Ireland seconded the motion. Motion passed unanimously.
Debbie Quinn noted that there has been a request by Harry Collins,tegal counsel for the Brush

Creek Homeowners,Yhat the discussion on tl�e 1GA between Brush Creek and the County be held y,�
in the format of an executive session.
Mr.Collins candidl that if the meeting is held in a public session that nothing will be .
accomptished. He also feels that the nature of the issues is such that it would be more

i appropriate for an executive session.
, After a discussion,it was agreed that an executive session will be scheduled.
