Leslie Lamont,Dorothea Fazris,and Shellie Roy Harper. y� q .,i COMMISSIONER MEMBERS ABSENT: Commissioner Bill Tuite. ,�' WOODY CREEK MOBILE HOME PARK HOMEOWNERS' � ASSOCIATION - NO MOTION - WAIT FOR RECOMMENDATION FROM HOUSING BOARD: Tim Whitsitt, representing the Woody Creek Mobile i Home Park Homeowner's Association,stated the Association wishes to acquire the properry their mobile homes reside oa The Associarion has contacted Mr.Michael Underwood,owner of the mobile home park,to express their interest in acquiring the properiy. Mr.Whitsitt said Mr.Underwood expressed an interest in the past to work out a deal with the Association to � acquire the property but nothing ever came out of the discussion. Mr. Whitsitt stated the � residents have attempted everything from friendly condemnation proceedings to numerous �µ contracts in attempts to obtain the park from Mr.Underwood. Mr.Whitsitt stated there has � been no disagreement on how much the pazk is worth but Mr.Underwood will not cooperate. � Mr.Whitsitt also stated the Association has brought this matter before the Housing Boazd and will be meeting with the Housing Board again on February 10,1997. t ' '� Jackie Lothian,secretazy for the Woody Creek Mobile Home Park Homeowners'Associatioq � � stated the septic system for the mobile home park is in need of repair. She stated the mobile home owners aze experiencing sewage backing up into their homes and undemeath their " homes. Lee Cassin,with Environmental Health,stated she issued a violation notice to Mr.Unde�v✓ood � over a year ago but no repairs have been made. Ms.Cassin stated the whole issue needs m be �:. sent to the State level but Mr. Underwood has not submitted an application to the State to "t� - repair the system. Commissioner Shellie Roy Hazper stated the situation needs to be resolved,mainly for safety '�� :�; • .,. reasons. . • �` Commissioner Leslie Lamont asked the Association whether they were aware of the letter sent �'� to the Woo Creek Caucus from Mr.Underwood statin he wanted to u rade die ark. Ms. �`'`'^ � dY 8 PB P ,�;.`',': ; Lothien resQonded both the MFiP Boazd responded and the Caucus responded to Mr. � ' Unde�wood. Both the Caucus and the Association opposed the upgrade. The Assocication 'f. opposed the upgrade because all of the expense would be bome by the homeowners. ��`^ . �;,';;;: . Commissioner Iretand suggested that�e Boazd have an executive session on this matter. �•-: ' Commissioner Ireland also stated he feels a sense of urgency to get this matter cleared up. � � . i�. Ms.Lothian submitted a rime tine regazding the mobiie home park A copy of the time line is made a part of the record and attached hereto as EXffiBIT"A." Dan Kenny,a mobi(e home owner,stated the owners would prefer to own the park$rst and '`'r • then repair their sewage lines later. Right now,there are approximately 54 homeowners in the ��'. � pazk and then there aze a few tentals. s" � Commissioner Ireland stated the Board will wait for a formal recommenda6on from �. � the Housing Board and then the Board will have an ezecutive session on this matter. Mr.Whitsitt stated the purchase of the property should cost each homeowner approximately i $45,000.00,sewage improvements included. He stated this is a rough figure. . J iCommissioner Ireland moved to adjourn the meeting. Commissioner Lamont seconded j the motion. The BoardofCountyCommissionerswasnotwiliingtohelpatthattime,Theinfrastructure - was not in the best condition and has only continued on a downward mode. TheresidentsformedtheWoodyCreekTrailerParkHomeownersAssociation, ��I' • - collected dues and the quest only became stronger over the years. ^! 1985-86 Michael and MaryJane Underwood purchased the Park and have been truly qreedy . � never put any money back into the property. The rents have increased by over � " $125.00 over the years that the Underwood's have owned. 'KR ' 1988-90 The residents again united and fnrmed the Woody Creek Mobile Homeowners �`7� Association carrying over the balance of funds from the original association to the � _ new. The association was Incorporated as a Non-Profit with the State of Colorado. - 1990-91 The Association By-Laws and Declarations were accepted by all the residents. Mr. , Undecwood stated pubiicly(at Woody Creek Caucus Meetings)that he would sell the park to the residents. The first contract went to Underwood. 1991-97 We have ofFered six contracts in this period,each rejected,then revised to sati'sfy ' iUnderwood's conditions. Still,none have been signed. Mike did � however sign a letter of intent to sell in November of 95,but has failed to show good faith in his commitment. � f � Our goai has always 6een the conversion of our rental spaces to sub-divided fee simple lots for permanent affordable housing.
