CALL TO ORDER; Commissioner Tuite called the meeting to order at 11:50 a.m.in the Plaza
, One BOCC Meeting Room.
COMMTSSION MEMBERS PRESENT: Commissioners Bip Tuite,Mick Ireland,Leslie
Lamont,Dorothea Farris,and Shellie Harper. �.�
�'. RESOLUTION AFFIIiMING THE PERSONNEL ACTION TAKEN BY'CHE ���
PITKIN COUNTY MANAGER-MOTION TO ADOPT RESOLUTION TO �
' `• UPHOLD DECISION OF COUNTY MANAGER--John Ely,County Attomey,
. stated this is an appeal that was brought before 2he Boazd by an employee who was
terminated from the recycling facility. The employee is Patrick Bergl. He was terminated
by his supervisors on March 4, 1997. The reason for that termination was the use of a
controiled substance on the job. The form of the controlled substance was marijuana. Mr.
� $ergl was using marijuana while on County time. Following the temrination,Mr.Bergl
� 1 took his case to the Personnel Review Boazd Grievance Appeal Committee. He presented
i his case as to why his ternrination was inappropriate. He did not request to be reinstated
! but requested instead that h-receive a severance benefit. The Personnel Review Board
1 and Grievance Appeal Committee agreed that there was cause for the temunation and that
�� the employee did use marijuana during his employment and during County time,that he
was aware that it was in violation of an established County policy promoting a drug-free
� work place,but that the employee should be entitled to some severance benefits. The
� decision of the Grievance Appeal Committee was then relayed to Suzanne Konchan,as
5 County Manager,pursaant to the Personnel Policies And Procedures Manual. Ms.
� Konchan reviewed the decision and accepted that the termination was for cause;however,
rejected the recommendation for any severance benefit in that there is no avenue for
severance benefits to be awazded under the Personnel Procedares And Policies Manual. -
The action of the Grievance Appeal Committee was therefore rejected,in part. The
employee has then appealed the decision of the County Manager to the BOCC asking the
BOCC to uphold the decision of the Grievance Appeal Committee. The issue is now
before the Board for decision as to whether or not to find that the Pitkin County ,
Manager's action�was for cause or was not for cause. ;

Commissioner Ireland moved,in light of tde above�ndings,that the Board adopt
the Resolution before it,as is,and uphold the County Manager's determination that I..`�,�'
- the employee is without beneftts or severance pay. Commissioner Farris seconded
the motion. :�'•
Commissioner Tuite stated he reviewed the proceedings. The Board has had several
meetings in executive session as is their right under personnet action with Suzanne _
Konchan,the County Manager,and John Ely,the Coanty Attomey.
