George McKerrow("Applicant')has applied to the Pitkin County Board of County Commissioners(`BOCC")to grant a one-year extension of the Conceptual Submission approval for the McKerrow Subdivision to give the Applicant additional time to prepare theDetailed Submission/Final Plat application. 2. The BOCC granted Conceptual Submission approval on July 12,2000, pursuant to Resolution No. 144-2000. 3. A Conceptual Subdivision approval is valid for one year from the date of approval. The Land Use Code("Code")requires that the Detailed Submission application be submitted withinthat time. Section 4- 110-020 of the Code allows the BOCC to grant a one-time extension of the Conceptual Submission approval, for a period of time not to exceed one year, if the Applicant demonstrates to the BOCC that substantial action has been taken in reliance of the conceptual subdivision approval. 4. The property is more specifically described in Exhibit A. 5. The BOCC considered the request at its regularly scheduled meeting on October 10, 2001, at which time evidence and testimony were presented with respect to this application. 6. The BOCC determined that the requested extension meets the criteria established in the Code, and,therefore, found the extension to be appropriate. 7. The BOCC determined that the Applicant may combine into one application Detailed Submission and Final Plat review. 8. Pursuant to the definition of Site Specific Development Plan in Article 8 of the Land Use Code, vesting occurs at Detailed Submission. The subject property is subject to all new regulations. NOW,THEREFORE,BE IT RESOLVED by the Pitkin County Board of County Commissioners that it hereby grants an extension of the Conceptual Subdivision approval for the McKerrow Subdivision until October 10, 2002, subject to the following conditions which shall run with the land and be binding on all successors in interest: 1. The Applicant shall adhere to all material representations made in the application and public meetings. 2. All conditions of Resolution No. 144-2000 shall remain in full force and effect. 3. The Detailed Submission/Final Plat application shall be submitted prior to October 10, 2002. APPROVED AND ADOPTED ON THE loth OF OCTOBER,2001.
