Mr.Magill and Ms.ETouben proceeded with their presentation as outlined in their Memorandum
to the Board. A copy of said Memorandum is attached hereto and made a part of this record as
EXHIBIT"A".
Chairman Tuite opened the hearing to public comment. Mr.Gordon Denton said as an investor,
� the fewer Govemment bodies involved make for a simpier and easier operation and was,
therefore,in favor of the swap. On the other hand,the following people disagreed. Mr.King
Woodwazd and Michael Conviser,both with the Maroon Creek/Castle Creek Caucus,Ms.Lynn ;
Mace,Ms.Ellen Randall and 3oe Kowar(sp?)were all opposed to the swap. The general �`
consensus was opposition to creating private commercia]enterprise in a rural remote azea.
- After the pubiic comments,Chairman Tuite polled the Boazd to see where they were tonight on
this issue. Commissioners Harper and Lamont still had unanswered questions and felt they
needed additional information. Commissioner Ireland had concems on future growth and uses,
Chairman Tuite l�ad quesrions on linkage and Commissioner Farris wtmted more information on
the inholding of the millsite and wanted to know what other parcets were available for the swap.
Commissioner Harper moved for a continuance to February 03,1998 at 3:00 PM.
Commissioner Lamont seconded the motion. Motion passed unanimousiy.
ADJOURNMENT: Chairman Tuite adjourned the mee6ng at 5:47 PM.

REQiJEST: The United States Forest Service requests that the Boazd of County Commissioners
consider and comment on ihe pending land swap between the Forest Service,owner of the Pine
Creek Cookhouse parcel,and]ohn Wilcox,owner of the Montezuma Mi11 site parcel(see attached
�$P� ,
BACKGROiTND:A U.S.Forest Service 1988 Decision Notice required that the Applicant make �,.
"all reasonable attempts to acquire private lands for new buiidings" prior to constructing new S�;
facilities on public lands. This decision notice is consistent with long-standing Foresi Service '�
policies to guide it's land raartagers to,where possible,have commercial ventures on private lands �
and use pubiic lands for outdoor recreationa!activiries. �

As requested by ttte Forest Service,the Applicant acquired the privately-owned MontezUma Mill
site.The Appiicant initialiy proposed new Cookhouse facilitees on 13us parcel,'as part of the 1944 j
,i Ashcro8 Master Plan land use appiication.In the Spring of 1995 there was a negatave reactioa from
the Forest Service,the Community Development Department,Mazoon Castle Caucus,the Aspen
Historical Society,and adjacent neighbocs to some of the Applicant's proposals.During the Spring
1 of 19951and use application process,the County Staff recommended that the Mil1 site be traded to
� the Forest Service for ihe existing Pine Creek Cookhouse site.This would achieve the objecrives of
{ locating the Cookhouse on grivaYe land and avoiding disturbing a new site. This proposa! was !
� considered and conceptuaily supponed by the BOCC at it's 7une 28,1995 worksession.The Forest '
� Service subsequently initiated the land swap process which has been on-going. �
� STAFF COMMENTS:The existing Cookhouse operations aze under a Forest Service Special Use t
� Permit(Granger-Thye Permit,attached).The Forest Service has expressed a wish to discontinue
this particularly cumbersome permit and remove the public's responsibilities in maintaining the '
structures by trading the Cookhouse pazcel for a privately-held parcel.
As Staff understands it,the main concem of the Forest Service with relinquishing ownership of the
Cookhouse tand is the County's ability to lie the restaurant operation to the skiing/outdoor
recreation operations through the rewning and master plan approvals.The Forest Service does not

Rob Iwamoto,District Ranger of the White River National Forest,indicates thai"Pitkin County's
decision regarding its ability for a"legal tie"will have significant bearing in the Forest Service's '�'.. ,
decision to pursue or not pursue this specifc land exchange."Based on the County's decision,Mr. '- ?
Iwamoto will then"consider the viable options available to the Forest Service to address the Pine �' ''
Creek Cookhouse, Ashcroft Ski Touring, Inc's Master Development Plan and possibly an
alternative land exchange(i.e.,pazcels closer to Aspen and other developments)."Mr. Iwamoto ? `�'

Both the Resort and Ski Area permit processes aliow for the Forest Service to maintain ownership ''' -
of the land and pmvide the ability for an operator to improve the pmperty.These lease/permits are
generally for longer periods of time(30-50 years)in order to assure value for the operator.The ,!;�
existing Granger-Thye Permit requires that the Forest Service own the land and maintain the ;
liability for the structures. � �t'y,
The continued use of the Pine Creek Cookhouse as a long-term accessory use to the recreational �'"c
; activities of the upper Castle Creek Vatley could be in jeopazdy if the Forest Service relinquishes `. ' ;
� control of the land, mainly due to an inability to assure that a privately-owned and managed �'�j i�
�
business will stay in business and/or maintain current levels of service. If the property were to � �
. remain in the public domain then there may be more options available to maintain the Cookhouse �
as accessory(and complementary)to the recreational opportunities in the Valley. �� `

The County$as the suthority to place certain conditions on the use of the land tku�ough the land use
review process,as defined in the Pitkin County Land Use Code.These conditions go with the land �' �
. and aze binding on current and subsequent owners of the property.Staff believes that the restaurant
• operation can be legally tied to the ski/recreational azea and remain a use that is accessory to the
outdoor recreational uses. Staff believes that the County can maintain these connections through t
zoning regulations and specific conditions of approval. Deed restrictions can also be utilized to
insure the future use of a particulaz pazcel of land.
The County Attomey concurs with Staf�'s position on the Counry's ability to enforce zoning ! �
, regulations and impose specific conditions of approval which would"legafly tie"the restaurant :. :��
operation to the ski/recreational area. �

Zoning: Staff has determined that the Montezuma Mill Site pazcel is wned Rural and J "'>
Remote, not AFR-10 as maintained by the Applicant. Even though the Ashcrofi Ski Touring '� '...;,
Masfer Plan land use application was deemed substantially complete before the 1Vlontezuma parcel �
was rezoned from AFR-10 to R&R and should be considered a pipeline case,it dces not change the
fact the pazcel has been in fact been rewned.

Plans,provided the development of these pazcels conform to the provisions of the vested approval:' ' �'
