Lance Clarke,Deputy Communiry Development Director,introduced this item as a continued '��
public hearing on the Highlands Base Village Detailed Subdivision for the rezoning and for the
subdivision approval. Two separate actions are required which are approval of the Resolution
for the Detailed Subdivision and approval of the Ordinance rezoning the property. Those public
, hearings were advertised and held at the last meeting of September 24th and continued to this
date to allow the applicant do some additional work primarily with Dan Blankenship,Roaring
Fork Transit Director,and Bud Eylar,County Engineer. �

With respect to the work with Dan Blankenship,tl�ey needed to come to an agreement as to how �
the dial ride service would be structured and also as to how it would be structured that an
additional bus would be added to the Castle/Maroon route;what triggers there would be to make
that happen.
With respect to the work with Bud Eytar,they needed to work with some additional items
associated widi the construction management plan regarding parking,tool storage,etc. As well r�
as the fact that the applicant had distributed to us just two days before that meeting,two very key . � ,
documents. These documents are the Detailed Submission Consolidated Plan and what has been
attempted with these,is to represent,when completed,the actual Detaited Plan Document that
will be recorded,to be used as the primary document to judge all the zoning approvals against .�•
when it comes through for building permit. He referred to a short memorandum from him to the
Board,that outlines where we've been and where we are going,and the fact that today,we are *��

Clarke referred to some additional items in the packef inciuding a letter from Glenn Horn of '
September 24th,where he details alJ of the changes that have been made in the plan since it was 'y'.,�'�,
first presented to the Board at Detailed Submission and today,and those changes are represented
in these two documents. 1'he other document in the packet,is an October 17th letter where Mr. !=`: �•
Horn has responded to some of the questions that came up at the last meeting regarding some
additional information we wanted to have in the PUD Guide regarding colors,reflective roofs, �s;?':,,�-
etc.,he talks about the bench mark,which is going to be established for elevntion and where that �: ^.
was going to be established,tree removal,transit plan,construction plan,weed management plan ''''�?"
and those things are all attached. Attachment 1 is what has been worked out with Dan �`� `
B(ankenship for the Castle/Maroon RFTA route;when tUe busses will be added. It also details �>:-' =' '
the"Dial-a-Ride"system. Attachment 2 of t6at is the Construction Management Plan,and Uie •
changes that have been made in that are shown in itatics and those were some additions that Bud � �
Eytar had wanted and there is also attached to that an updated landscape plan showing the
concerns that Steve Anthony had with regard to wildflowers. A copy of these documents are
attached hereto and made a part of this record as EXHIBIT"B'. -

Mc Clarke said there were a couple of questions that were left hanging at the end of the last " �
meeting. Commissioner[reland specificaily left the meeting saying that he was coocerned that
we have some discussion about the length of construction of tUe project;talk about some type of ���
time limit to build out on the project;in addition,some discussion about long term obligations
. and to whom they are going to be transferred and how that transfer is going 10 work. So in this
plan there have been some changes from the concepts that were dealt with before,a lot of word n
� something diat needs to be done,and a lot of previous documents that are in flux such as
� commission members have in these two attachmenLs are going to go into this document. He
pointed out that there are a couple of things that are differenL
With regard to the Aspen Consolidated Plan,Clazke said there l�ave been some changes in the
' affordable housing makeup. Primarily there were originally 112 units;there are now I 11 deed
restricted units,but there are actualty more employees housed than previously and to a great
extent,that has to do witli the reconfiguration of the dorms. W ith the redesign of the `
dormitories,they are housing more people than required and the request is to either not construct
. all those units or to use them to offset future housing exaction's. His recommendation would be
that they do construct them;he does not think they should have the right not to construct them,
but perhaps it would be fair that they could use them to offset future housing shortfalls that
might show up through the audit requirement. There is a requirement that we do a housiug audit
one yeaz afrer Phase IV is complete 10 see if indeed,the employee generation and the housing (.
numbers match up. What the applicant is proposing,is for some reason that tfiey would sfiow
that tliey have a shortfall ihat they could use the 13.1 pereent person credit.
Commissioner Lamont commented that if the 13.15 extra credit units are represented in what we '
have been looking at for awhile then where are they going to be eliminated from and where do
we put them back,etc:? ��'
Bob Daniels,representing the applicant,responded that they agree to build them. i`

and that in the summer they be used for the Music Association of Aspen.
Chairman Tuite said this raises the question then do we want to look at this as a surplus and give ' �>
the applicants credit for a potential shortfall in the future or do we want to say"It is what it is", ';.;.
and leave it at that? '.
Mr.Daniels said their preference would be that if the audits come back and show that there is
additional housing that these be appfied before the shortfall in the audit.
Chairman Tuite expressed a concem that by helping out the MAA,are we going to recognize ;Y•` ''
� "extra employees"when in reality,they are not there year-round. He reminded everyone that ,
staff recommended that this not be done period,but rather that the project house their people ..
year-round that are going to be impacting because ofthis project. :
Gideon Kaufman said they have a village they have worked on very hard and if there is a '.
shortfall down the line,ratlter than having to pay more money,or rather than having to come up
� with a situation where they have to be more housing,it seems ro him that naturally U�ey would
get a credit for the surplus Yhat they are willing to build it. The communiry gets the benefit of it,
' but if they have a s[iorifall later on,they should be able to get credit for it.
Commissioner Ireland suggested that Board allow them a credit for three quarters because three
quarters ofthe units are definitely offsetting employees and the other is just MAA related. '.
Mc Daniels responded that for those additional units,they go into the dorm,and based upon the -
; recommendation that has been made,he U�inks this a fair way to deal with it for them. They will
! take 75 percent credit for those additional dorm units or that bodies that go into a dorm.

� ' Lance Clarke referred to another change where the applicants were allowed to reserve ceRain
units for Hines and Ski Company employees attd the idea was tliat tiiey would the be sale units
� ' for the first sale only. He said the new language states"Upon the subsequent sa1e,the units will
� ; be first offered to qualified Hines/Ski Company employees by right of first refusal, and then to
� any qualified employee".

� � Gideon Kaufman responded that the fogic behind that is that one of the things they are trying to
do,is accommodate tlie traffic issue,by keeping their employees on site.

Chairman Tuite suggested that it be(imited to Aspen Highlands employees,but if they are
talking abouY a Ski Company that works at S�owmass that mutes the issue.

Bob Daniels explained that the Ski Company sometimes move their employees from mountain to
mountain,but they would try to work with staff to develop some language that first priority goes
towards someone that would be working at that mountain,if that is the desire of the Board,in
addition,they woutd need to meet the employee housing authority minimum standards;income
' occupancy,net asset va(ue,no additional property,etc. - _

Lance Clarke exptained that another change is tliat tha Hines/Aspen Skiing Company reserve the
right to lease all seven rental units to qualified Hines or Aspen Skiing Company employees as a �. �.y
top priority. The resolution before said that they wanted to lease two of the units and now they y�•�='- �.
are asking for a!1 seven. • .
It was agreed that this proposal would be acceptable. '
Lance Clarke explained that another change has been made to page 21 under the Definition of 9�r'.'.
Activity Envelope. He said they have estabtished for every lot buitding envetopes and activity ,,:-r,�"
envelopes. All buildings will be within the envelopes,but they established activity envelopes ` '
because there are some cases where driveways are going to have to go through some sloped areas � �^
and there is going to have be retaining walls and typically,anytime a retairting wal!is bailt you �'� `
have to go through the Board of Adjustment to get a variance because anything over 30 inches in `
the setback is considered a structure and requires a variance. Therefore,this language has been (y. `.
added so the developers don't have to go before the Board of Adjustment every time this

happens. �
He recommended tliat the language state"The activity envelope encompasses the building ' .
' envelope. Driveways,grading,landscaping,and retaining wafls may take place within the !.';?
activity envelope. Buildings,sheds,pools may be conshucted only within the building envelope. '�c
Retaining walls located outside Uie building envelope,wiUiin the activity envelope,shall not �'�i
exceed six feet in height,provided lots 9 and]0 in the Thunderbolt neighborhood may have �,';i
higher retaining walls. Where there are retaining walls,there will be stepped-back or terrace
• wall structures with planting pockets where grade changes exceed six feet. Decorative walls -
located outside the building envelope,within the activity enveiope not used for retainage area,
are prohibited." With respect to berms,Clarke said the language will be changed to read"Berms
located outside the building envelope,but within the activity anvelope,will not exceed two to
one slope or three feet in height" The idea being in both instances,is to avoid the walled off
concept along the street.
� Chairtnan Tuite questioned if you could add a five foot fence to the top of the berm7
It was agreed tUai language will be fudher amended by adding language which states:
"The total height of the berm and fence will not exceed six feet"
j Glena Horn stated that the applicants and staff will come up with an additional sheet that shows
just activity and building envelopes where they drop the topo lines out so it will read much
better.
Mr.Clarke said other than those main points,the other concerns he has with the plan,are
primarily word smiting that they are going to have to change for the final draft particularly with
respect to response to General Submission conditions which refer to specific appendices and .
speciftc things that have or have not happened they are now in a different appendices and maybe
they have already taken place,and that all tteeds to be adjusted. But as far as the primary �
conceptual issues that he had,had to do with the change in the housing situation.He said the
only additional concern he has is with the design of the afFordab(e housing units. He dces not
think tl�e units meet the dialogue with the design of the$ase Village. Therefore,he suggested to �
Uie project planners that they talk to the architect about that,and he has made some changes. He �; . ,

Commissioner Lamont said in reviewing the phasing aspect of the project,when Phase(is "
addressed,it looks like it is more than just tlte basic infrastracture,but in addition,there is focus ��+� `;
on the Maroon Bowl neighborhood. She questioned when the lots in tltis neighborhood would be !' ' '��

Mr.Daniels responded that these lots woald have the opportunity to go to the real esiate market t,'� - ;
after final plat. 77iere is tto requirement,because this project is less than a l00 units,tlie
infrastructure Isas to be complete prior to offering the lots. He said with respect to buildittg .'.;,� .
permits,they would have to deal with life,health and safety issues,which are typically powey •y:'``:; ,'
water,sewer,fire depathnent access,ete. He said their plan is if they are able to proceed in �=#�>;�- '`
April,is to initiate construction on Yhe parking structure,Buitding 7,which is skier services,and

get the skier services built in one complete season. So they are not able to initiate any housing i''.'' '
construction or any habiYual construction in the first year,but they are hopefu!to do it in the

Commissioner Farris said she would like to see some employee housing come on line at the k
same time ihat building permits for free-market units are issued. '
Mr.Daniels said what they have anticipated is that when they get into the Subdivision �'r
Improvements Agreement and start to talk about obligations of the deve�oper,that tlaey will start �,�'
- to deal with timing issues and measures oFsecurity for execution of those obligations;bonding
for some specific public improvements. He thinks at tfiat time,they will have a discussion with
the Board as to whether or not they consider affordable housing to be a public improvement
They feel that prior to coming to the Board to discuss this issue,that it woold be more
appropriate to discuss it with the County Attomey,and they will take this concern into mind
l when they startthese discussions.

' Commissioner Farcis referred to the Construction Ma�agement Plan,which]imits deliveries to
�� the Base Village from 8:00 am to 830 am and no deliveries from 2:SOpm to 3:36 pm. She said `
her concern is,is what time all that construction traffic has to be on Highway 82 to be there at �•

acutety aware of che issues associated wid�deiivering material. And their first question to them 1,
was when in the off hours can we deliver and stock pile raw materials. Therefore,he thinks from i
both of their standpoints,they have a Iot to gain there because material costs are more expensive ` .
for them if they are sitting on the highway.

Mr.Daniels commented that they had a two-tiar approach to this issue. They had a first tier of �`�='��%

these times in here realizing that as the school adjust their times,they will have to be flexible,in i�
addition,there are review provisions in here with the Co�nty Engineer on an annualized basis. �:�; ..
The stockpiling was trying to address the kind of larger,outside of the neigltborhood issues � •�'_
relative to Highway 82. Also,tbey 6ave put some specific requirements on their contractors _'
about van pooling,cac pooling,and them having enforcement measures in dieir eontracts.
Chairman Tuite said he thinks the neighborhood's position is also crucial. p�'':^. �

Mr.Daniels said they witl certainly include the superitttendent of schools and a member of the
Castle Maroon Caucus on the list of their annua[review.
A discussion ensued as to whether or not it tivould be feasible to have a batch plant on site. , "

' Mr.Daniels wl�at they wanted to do is maka sure that they had a contractor on board who was `

competent to address this issue,and when that contractor is on board,deal wiUi the Counry and � '
deal with tlte neighborhood and come up with a plan. ` .

Glenn Hom suggested that tf�e applicants and staff work on the issue of delivery traffic,and iry �r.
to refine it,based on the Board's comments today,and work with their contractor to revise this in
a form that is more acceptable prior to them getting excavation permits. x�
Commissioner Ireland suggested that the County Engineer have the ability to look at this and �
give his approval or to say that the window should be larger or smaller.
It was agreed that the fifrh paragraph on the second page be revised to say"Prior to the first
? construction season program and each season program thereafter,there will be a meeting witli
` RFTA,the SherifT's O�ce,Schoot Superintendent,the neigltborhood,the Pitkin County
- S Engineer and the developer to review the work program."

Commissioner Ireland suggested that the on site batch plant idea be discussed in these meetings
' also.

�� Sob Daniels said his concern would be if someone in the neighborhood did not like the batch
� plant,after it was placed on the site. He said he would like to impress upon this Board that they �
; have taken contractors to task about their schedule,the batch plant,and all the other ideas,but if (�
t' they set a course in the beginning of the year(April as proposed)i.e,a batch plant or stock piling t
! materials,if they change that in June,it would be a huge impact to them. �

Chairman Tuite said wliat is being talked about is thousands and t[iousands of truck loads of
eoncrete. And if you are a neighbor trying to get in and out of there,a batch plant that could � .

work at certain times of the day and complete the project versus the truck traffiq the batch plant `
would be the best solution. He thinks the batch plant could be narrowed down to a speciftc �
season or two.

taken into consideration when the developers are working with their contractor. Also,with y�" .

` when and how that money can be used because the FEIS does not have a range of alternatives

service plan which may be modified in the future to meet actual
demands of residents and guests as the proper�ies are built out. I
Service will be initia�ed with two vans when the developments start
to be occupied in approximately the year 2000. The fleet of '
vehicles and service may be expanded as the developments grow. �
Service will be provided to the two areas illustrated by Figure 1. , '

During the peak season(s) , Route � 1 will serve the Aspen Core_
Dial-a-ride vans will provide service on a fixed one-half hour �
schedule generally following the route depicted on Figure 2. Three � "��
check points will be established in Aspen, potentially at Mill -
Street/Hyman Avenue, Cooper Avenue/Spring Street and at Rubey Park. .` '
The vans will pass these checkpoints on each circuit route so i� � �
patrons are not reuuired to ca11 for service. Two vans will -
provide one-half hour headways at the checkpoints.

Mr.Peter Martin asked if the whole Redstone Boutevard was within the Scenic Overlay. Ms.Wolff said

at which time the first reading and public hearing was continued to allow staff to provide additional I , �
_ background on the Redstone Master Plan and other issues raised during the hearing. After additionat ', •_
discussion,the Ordinance was approved on first reading on July I6. �"

Boundarv of Scenic Overlav: The ori¢inal map presented to the Board designated the scenic overlay '��r
boundary based on physical feamres.such as the east bank oFthe Crystal River and the toe of the slope to ;��
the east of the highway. The scenic overlay regulations are applicable to"Development on any parcel of r
land which fa11s within or is crossed by the 5cenic Overiay",and,therefore,would be applicable even if the �'!
proposed development is located outside of the scenic overlay boundary shown on the map. vlappin�the ;�
overlay areas based on physical features is consistent with the overlay mapping for other areas of the
County,however,this mapping�vas done before staff had access to the more sophisticated mapping
technology that we now have with the GIS system. To make it cleaz that the regulations apply to
I development anywhere on the parcel.the Board suggested that the boundary be drawn along the property
j lines of those properties within the overtay area. The regulations woufd app{y the same under either
mapping scenario: when development is proposed on a parcel within the overlay area,staff will determine
i based on a site specific review whether the development is exempt from the regulations,requires an
administrative�eview,or requires review by the Pfanning Commission. Staff will present maps at the
meeting that depict the two potential boundaries. Staff agrees with the Boazd that using property lines to
delineate ihe boundary is rnore clear.based on the current laneuage ofthe Code. �
Some communities are currently usin�3D modelling to designate areaz subject to scenic review. These
models allow much more specificity in defining what is visible,and,therefore,subject to review. The
Community Development Deputment is starting to work with this technology,and may be able to refine
the mapping of all of the scenic overlay azeas in the future to be more specific.
RECOMMENDATION: Pursuant to the recommendations of the Redstone Master P{an,staff and the y
Planning Commission recommend that the Board approve the proposed text amendment to apply the scenic � •
'overlay regulations to certain areas along State Highway 133 adjacent to Redstone as stated in the attached , c
Qrdinance,and that the Boazd adopt the proposed Scenic overlay map for this area.
