2. The Applicant has also requested an amendment to Section �
p 3-4.2 of the Land Use Code to modify the language in footnote 'o

� units which can be constructed in association with a business ,��
� (� use on the same property within the B-2 zone district, and to Z�
� require such units to be subject to speciaZ review approval t��

found the Applicant's request to be consistent with the ��

� `° recommends approval of the requested Special Use Permit and F-p •

- � �- 4. The Board reviewed the Applicant's request for Code n
� Amendment along with a request for special review approval �
and plat amendment at a public meeting on February 22, 1994, m�
� � at which time evidence was received and testimony heard with �G�
respect to the Applicant's request from the Applicant and the
`"- � Public. At that meeting, the Board tabled final action on the

, Special Review Use and Final Plat amendment requests to a
� public hearing on March 29, 1994 to allow a second reading on �'•
� �-� the requested Land Use Code amendment. � -

� 5. At a. duly noticed public hearing on March 29, 1994, the �
Board heard the second reading on the proposed amendment to � �-_
the Pitkin County Land Use Code. After hearing second reading �;�°
` and testimony from the Staff, the Applicant and members of the 1�"-'
� Public, the Board found the Applicant's request' for Special o '(� �
� �' Use Permit and amendment to the Aspen Airport Business Center �

approval for the reguested Special Use Permit and Final Plat
Amendment for Lot 2, $lock 3 of the Aspen Airport Business Center w
PUD, subject to the following conditions: J -
1. The Applicant should consider installing additional r�
landscaping on the property to proviae a more livable
environment for residents of the units. A site plan
G illustrating the landscaped area shall be approved by the �,
Planning office prior to buildinq permit application. Approval 4,
by the Planning Office shall be dependent on the Applicant a
, complying with the representations made at the February 22,
1994 Board ineeting regarding the location and quality of the �j
`�'~ landscaping on this property. G�
2. The applicant shall obtain any approvals necessary from the
City of Aspen for the provision of water for the proposed @
units. �

3. The Applicant shall record a deed restriction for each unit � -
with the approval of the Housing Office prior to building r
permit appZication. e
, 4. The Applicant shall aqree to join a road improvement district �
- �-. ` should one be formed. �o
5. The applicant shall obtain a buildinq permit for remodeling � '
of the existing units as well as for construction of the two N
new employee dwelling units. •

i 6. The applicant should consider the use of highly insulated �
_ M.'� . thermal windows, high efficiency heating systems, and low flow W �
water conserving fixtures on all dwelling units on the
,;;;� property. The two new dwelling units shall meet or exceed the
standards in the Model Energy Code.
� � 7. The applicant shall adhere to all representations made in the
j application and in public meetings. '
