L The Pitkin County Public Works Department, hereinafter

� "Applicants", have applied to the Board of County
Commissioners of Pitkin County, Colorado, hereinafter "Board",
for the following land use approvals:
- a:. 1041 Environmental Hazard Review, pursuant to Section 5-
400 p �'
b. General Submission, pursuant to Section 6-3;
`�� :� 2: The applicant proposes to construct improvements to State _ ,
'.� Highway 82 in the Weller Lake area approximately 8 miles east
of Aspen. The project is comprised of the following ;
� '.
�:, components:
— ."�: a. Realignment and softening of a sharp bend in the road at the point
� known as the Weller curve.

y,� b. Creation of a parking lot for the Weller Lake trailhead on the
�; current road alignment to replace the existing parking lot which has

,�,� 4. The Planning and Zoning Commission heard the application �v
� at their regularly saheduled meeting on April 26, 1994, and �.
� recommended conditional 1041 Ha2ard and General Submission �

� approval of the proposal to the Board. �

, 5. The Board heard this application at a regular meetinq on �s�
� June 14, 1994, at which time evidence and testimony was
_ '. � presented with respect to the application.
� 6. The Board finds that the Applicants have complied with
� :� applicable Land Use Code criteria for a 1041 Hazard Review and
�
General Submission.
. :� NoW, THEREFORE, BE ZT itESOLVED by the Board that it does

�� hereby grant General Submission and 1041 Hazard Review approval �
� subject to the following conditions: �

z„ 1. Construction of proposed road and parking improvements shall
---� occur during the months of June through September of this
;;��y year, weather permitting. Construction of trail improvements
f� shall be undertaken as Phase 2 of the project and delayed •
;; until potential riparian and wetland habitat impacts can be
assessed b the DOW and Arm Cor s of En ineers and trail '
�.� y Y P 9 ,
' designs modified as necessary. Final Planning review of �
`�,; groposed trail improvements shall be processed by th� Planning
r� Office administratively, unless there are issues which cannot � �
_ be resolved by Staff, in which case review shall be brought � "•
to the Planning Commission and Board. � `��

2. Grading, drainaqe, erosion control and landscaping plans shall ,' j
-_ be finally reviewed a�d approved as part of the earthmoving ���� ,
� permitting process by the County Engineer and the Public i��
�`' Resource Department. As part of the earthmoving permit, ,.�
stockpile locations for rock and dirt shall be established. •� �

°'� and successful propagation of new plant life. Watering shall �` �
� be conducted by County road crews on a regular basis as �
determined by the Public Resource Department until �«�•:
revegetation is successful. Where possible, displaced aspen �'
`� trees shall be saved and transplanted. A County earthmoving `;' `
� permit application shall be submitted to the Building k '�
Department prior to commencement of construction. �

� 3. A construction traffic plan shall be submitted for review and
� approval by the County Engineer and the Calorado Department
� of Transportation prior to cammencement of construction.
� 4.' A fugitive dust control plan shall be submitted to the
; � Environmental Health Department for review and approval prior
.�� to commencement of construction. At a minimum the plan shall
� address the watering of disturbed areas, watering of dirt and
r . rock prior to removal, the daily cleatting of adjacent paved
- roads to remove mud that has been carried out, and speed
limits or otheT measures necessary to prevent windblown dust
- from causing a nuisance.
5. Construction shall be limited to the hours of 7:00 a.m. to
7:00 p.m. on weekdays. �,
- �, ` 6. The applicant shall submit a 1041 Review Site Plan `
est'ablishing a project area improvement envelope in which all
proposed improvements shall occur. Improvements shall be
limited to the envelope. The Plan shall be submitted for
review by the Planning Office and County Engineer for approval
� prior to submission of the earthmoving permit. The following
1041 Hazard Review Warning and disclaimer shall be placed on
_ �.r; the Plat:
"The provisions of these regulations do not in any way assure or
imply that areas autside of designated hazards will be free from
hazards, or that approved mitigation measures will guarantee the
a safety of the property."

� 7. All material representation made by the applicant in the ..,
� application and in public meetings shall be adhered to and
� considered conditions of approval, unless amended by
'� subsequent conditions.
