The Board of Coanry Commissioners appointed a Home Rule Charter Task Force in �.� 1993 to review what issues maq be appropriate for amendment or clarification in the Home Rule Charter. ti�l2. That Home Rule Charter Task Force met over a series of months and reviewed the Charter for mvltiple issues including some specifically identified by the Board. � 3. The Iiome Rule Charter Task Force has completed recommendarions to the Board,which are attached to this resolution as Exhibit 1 and incoKporated herein by reference, 4. The Board set for election in 1993, the quesdons put forth by the Home Rule Charter Task Force,but a technical deficiency denied the voters the opportunity to vote on these questions. 5. The Board still seeks the guidance of the electorate on these issues. NOW Tf�REFORE BE IT RESOLVED, thaC � 1. The Board of County Couunissioners of Pitkin County,Colorado,elects to refrain from _ � . � returning to the ballot the question of amending district by district voting to voting-at- ;,,� large. 2. The Board directs that the following questions shall be placed on the ballot for the primary election in August in a manner tha[ ailows these questions to be voted on individualIy: • 1. NOMINATING PETITIONS -- Shall Secfion 6.2.2 of the Home Ruie Charter be - --- repealed and reenacted to reduce t6e number of signatures required on nominating petitions from 250 to 50,and be limited to persons residing within the district from which the candidate seeks - election, if and oaly if Commissioners are elected by district, and to read as follows: 6.2.2 A candidate's petition must be signed by not fewer than two hundred and ' fifty(250)qnalified electors. Persons signing a candidate's petiuon need not be registered to vote; need not(in the case of party nominees)be a member of the party by which the candidate has been designated;need not ! be a resident of the dishict (if any) from which the County officer is ; nominated; need not state that(s)he intends to vote for ttee candidate at the ensuing primary election; and may sign petitions of any other cand- v' i idates for the same office. RECALLS--Shall Section 73.8 of the Charter be repealed and reenacted to clarify that � any elected officer,having been elected by a given consdtuency, may be recalled from office by the same constituency (for example, Commissioners elected by a vote of their own residential district may only be recalled by a vote within their residendal district and Commissioners elected at lazge may only be recalled by a vote at large),and to read as follows: 73.8 There shall be printed on the off'icial ballot, as to every officer whose recall is to be voted on, the words, "Shall (name of the person against whom recall petition is filed) be recalled from the o�ce of (title of , ( office)7" Regardless of minunum requirements in the state recall statute, ' ; the reasons for recall, together with the officer's statement of defense, shall be on the ballot in accordance with State law. The ballot shall 4. provide for a "yes" or "no" vote. The recall elecdon shall take place among the elecrorate by which the subject County Official was originally '.; elected and is representing. 3. T'WO TERM LIMITATION--Shall Section 2.4 of the Home Rule Charter be repealed r:�' and reenacted to state that Commissioners shall not be restricted as to the number of terms served but shall not serve more than two four-year terms consecudvely,and to read as follows: . 2.4 Terros of Office The term of office for commissioners shall be four (4) years, with a majority of commissioners elected at the primary and general election in years in which the President is elected, and the remanvng minority of commissioners elected at the primary and general e(ection in yeats in 'which the Governor is elected. - `"' Individuals serving as Commissioners shall not be restricted as to the - number of terms but shall not serve more than two(2)consecutive four- year terms. • _ 4. IMTIATIVE AND REFERENDLTM—Shall Sections 7.1.1 a�7.1.2 of the Home Rule Charter be repealed and reenacted to correct an inadvertent oversight so as to include ordinances ,�;. as actions subject to initiative and referendum, and to read as follows: 7.1 Initiative and Referendum 7.1.1 Initiative: The electors of the County shall have power to propose any f � � resolution or ordinance to the Board in accordance with the provisions of ;�.a this article of the Charter, except those concerning land use applications, �, the annual operating budget, annual appropriations budget, and levy of taxes. Peraonnel matters should be left to the full time employees (i.e. :,i the county manager, department heads and personnel department). � Advise and oon6ent over the appointsient of depaxtment heads is a responsibility the 8oard does nat need and probably is not in a , position to effectively fulfill, in any �vent. Clearly, whenever , the board feels that the�manager is not doing a good job oE either Imanaginq the county or implementing zhe policies af the board, it " can find a new manger. In the committee�s opiriion, this should be � the extent of the Board's involvement in pezsonnel matters. I ! Altliough we appreciate Commi'ssioner Iraland�a attempt to #armulate the proposed compramise, we respectful'ly suggest it•is x:?� not warranted in thia case, nor will it make for more effectiva °``'? ' 9avernment• Remember, these depaz�kraent heads are not appointments� � �- ` #or.li#e, like supreme cowrt members, nor are department heads part of a separate branch of qovernment, as the exeautive and judicial � branches are separate #rom Congress. ' The Task Force recommends, unanimously,l that the number of :' i ` � Commissioners be retained at five. With a Board of � ; i five, these circumstances are less likely to occur. �lection of Commissioners By virtue of a ballot proposition adopted in November, 1992, G `- the Charter was amended to provide that the County is to be divided into districts and one Commissioner is to be elected fram Fr_ each district. Section 2.2, Three members of the Task Force urge that the voters be afforded an opportunity to return to the prior arrangement, , election at large, but with the requirement for each Commissioner ; " to reside in a separate district. In a county of this relatively small size, it is preferable for each Commissioner to be obliged '�" to serve the whole population, but it is also desirable for each Commissioner to have a connection with a separate d3strict. The � prior arrangement strikes a reasonable balance between those considerations. • • Two members of the Task Force wquld retain the district-by- i:; district voting arrangement until we see how it works. ' Bbsences '� t The Task Force was asked to consider deve).oping a provision 1,�-- to the effect that a Commissioner who was absent for a given � ntuaber of ineetings, without a persuasive excuse, would be deemed ,�r � to have abandoned the office. S 4;' - How should absences from special meetings and joint meetings be considered? � - What are appropriate standards or guidelines for what Icould be accepted as a persuasive reason for an ' absence? . j ; Compensation of Commissioners � i 1 - Four Task Force members hold that no change in the present � compensation of the Commissioners is warranted. Section 2.5. f j � '`�* :� One Task Force member urges that the salaries of the ? � . fI - Commissioners ought to be increased to a sum on the order of $32,000. � Term Limits . ��— By an amendment adopted in 1988, the Charter provides that a Commissioner may serve for no more than two four-year terms. Section 2.4. Four members of the Task Force recommend that the limit be changed to two consecutive four-year terms. Thus, the County Board ouqht to focus on adopting, altering, and , �� deletin Count � g y poli:cies, by ordinances, resoZutions, and otherwise, and by ruling on matters which properly came before � it, but it ought to refrain from decision-making with regard to the management of County government, except, of course, to - appoint and to discharge the County Manager. In turn, the County � - Manaqer ought to foeus on the administration and management of � . the day-to-day functioning of the County government and, while = ., i advising and making recommendations on policy questions, ought to refrain from making or altering any County policy. Agpointment of Departme*++ Aeads � With the foreg�ing in mind, the Task Force recommends that ` the Home Rule Charter be amended to relieve the County Board of the role of appointing department heads and, instead, to leave this to the County Manager.
