DESIGN AT THE SMUGGLER MOIINPAIN SIIPERFIIND 3ITfi AND f �.
COMMITTING TO MAINTAIN REASONABLY COMPARAHLE �
� RATES FOR ACCEPTING EXCAVATION MATBRIALS FROM SATD
SITE AT THE COUNTY LANDFILL

' RECITAL3
1. The BOCC is currently contemplating entry into a Conaent
� Deeree with the EPA which will finally resolve issues regarding
its fi.nancial liability to the EPA as a Responsible Party by virtue
� ' of its ownership of property within the Smuggler Mountain Superfund
� ' Site ("the Site") .
2. That Consent Decree contemplates that the BOCC shall "
undertake a remedial work plan to complete the Phase I remediation �
of several parcels of land 2ocated within the Site. Said decree
further contemplates the passage of Institutional Controls by the
`'�' BOCC which would restrict, through the building permit process, the :
future excavation of residential soils within the Site.
� 3. The BOCC is further nearing completiom of negotiations
whereby certain excavated residential soils from the Site,
; , containing I-iazardous materials, may be removed and deposited at the � '
, � Pitkin County Landfill.
-.--- 4. There is public concern with respect to the BOCC's
intentions regarding the development of workplans and as to costs
for permits or the deposit of excavated materials at the landfill.

- � 5. Zt is the purpose of this Resolution to set forth for the
� benefit of the public the intended future course of action of the t! �
� BOCC with respect to each of said matters.

< NOW, THEREFORE, be i� reaolved by the Hoard of County $
t Commissioners of Pitkin County, Colorado, that:

1. The BOCC shall provide an adequate opportunity during the , �,,
�' period of its implementation of the remedial work plan
�� required by the terms of its Partial Consent Decree with the !� v
� � EPA for the public to participate in and comment upon that ;k.!
� work plan through quarterly public meetings noticed and held
� for that purpose. +� � �

additional building -permit fees, beyond that which would ;:�.�

3. The BOCC hereby commits that it wiI.l not place any �
surcharge at the County Landfill for the acceptance and
handling of materials excavated at the Site beyond that
charged for similar, noncompostable materials from outaide the r� '
