� RECITALS
�'� 1. The Pitkin County Open Space Board, hereinafter
� "Applicants", have applied to the Board of County
'� Commissioners of Pitkin County, Colorado, hereinafter �'Board",
� for the following land use approvals:

?�y a. 1041 Environmental Hazard Review, pursuant to Section 5-
�i 400; ,
� b. General Submission, pursuant to Section 6-3; �

,'�, 2. The applicant proposes to construct a public, non-
.�;� � , motorized recreational trail from the end of the existing bike
�
� path, approximately 400 feet west of the intersection of
� Aighway 82 and Stillwater Drive, to the eastern end of the �°

Northstar Nature Preserve.

-- 4. The Planning and 2oning Commission heard the application
�' at their regularly scheduled meetinqs on April 2G and June 7,

;� 6. The Board finds that the Applicants have complied with ; `
� applicable Land Use Code criteria for a 1041 Hazard Review and
$ General Submission.
� NOW, THEREFORE, BE IT RESOLVED by the Board that it does
hereby grant General Submission and 1041 Hazard Review approval
F,
subject to the £ollowinq cottditions:
1. This approval is for a non-motorized access, summer use trail.
(Winter use may be considered subject to further County
review) . The westernmost segment of the trail is approved
along the Highway 82 right-of-way from the end of the existing
bike path, which is approximately 40o feet west of the
intersection of Highway 82 and Stillwater Drive, to and across
the Stillwater Bridge to the south side of the river, where
� it will proceed east along the river, on existing easements,
� to the Northstar Bridge that was installed in 1992. After ��
crossing the Northstar eridge, the trail generally abuts the
V � Highway. The alignment is delineated on Exhibit 1, attached.
Native materials including clean fill (crusher fines) shall
,� be used for the trail tread, with boardwalk sections as
. ,':�, � necessary in wetlands. Native rock shall be used for
:� retaining walls along the trail. There shall be no paving east
�# of the Stillwater 8ridge. The trail shall be no more than S
feet wide with 2 foot shoulders on each side to accommodate
� summer pedestrian and bicycle use. �
� 2• Prior to commencement of construction, the applicant shall
obtain an earthmoving permit from the Building Department.
- -J`.� As part of the building permit application, the applicant
shall submit the following information:
� a. A comprehensive drainage plan including but not limited '
�t to volumes of flow, location and size of culverts, year
of design storm, energy dissipation, design and
; velocities; Grading, drainage, erosion control and
' ! landscaping plans shall be finally reviewed and approved
� as part of the earthmoving permitting process by the
County Engineer and the Public Resource Department.

b. A 404 permit approved by the Army Corps of Engineers; '`�{ �
The applicant shall adhere to all conditions of said �i
�' permit. d' `
c. A final wetland mitigation plan to be reviewed and ��
approved by the County Engineer and the Public Resource
Department. Fertilization shall be eliminated from the

' wetland mitigation plan. Timothy, Red Fescue and Potomac ;_ ' r
�� orchard grasses shall be eliminated from the plan and `'
hreplaced with native grasses such as Streambank
Wheatgrass and Sheep Fescue at the direction of the �*•'
j Public Resource Department. Provisions for supplemental
� irrigation shall be addressed as part of the plan. ��� �

� d. Topsoil stockpile location, covering, size and duration
� of stay. .
� e. Construction staging area/construction parking.
• � f. Written approval from the Division of Wildlife approving
the trail design and alignment with respect to riparian,
i trout and general river habitat improvements and with
{ respect to the Elk migration corridor.
�
g. Location of construction fencing to limit construction
; impact to private property, wetlands and the Roaring Fork
' River.
h. A revegetation plan for review and approval of the Public
Resource Department. �
m ' 3. Construction contractors shall be required to buffer all
' disturbed areas through the use of mulch, barriers (i.e. hay
,�j bales) to guarantee that stream quality is not impacted.
i Any straw product utilized as mulch shall be certified by the
i Department of Agriculture as "weed-free."
� 4. No herbicides shall be used to sterilize soil or for weed
� control.
5. The County shall obtain a Floodplain Development Permit from
-;� the Floodplain Administrator prior to commencement of
� construction. The permit shall address the mechanics of
�i closing the trail during high water periods and specify who
' 3 is responsible for monitoring; how monitoring will be
accomplished, who has the authority to close and open the �
trail and who is responsible for maintenance if the trail is
damaged by high water.
6. The applicant shall submit a management plan for the traii to
the Planning office prior to commencement of construction. "'s-'

� identified by the Division of Wildlife; specify that dogs l ��.

� be submitted for review by the Planning Office and County
'� Engineer for approval prior to submission of the earthmoving
` � permit. The following 1041 Hazard Review Warning and
_ � disclaimer shall be placed on the Plat:
� ���� _� . "The provisions of these regulations do not in any way assure or , � , ��
� �imply that areas outside of designated hazards will be free from

9. A construction traffic plan shall be submitted for review and
approval by the County Engineer and the Colorado Department
of Transportation prior to commencement af construction_
10. Building permits must be obtained prior to the construction
of uttderground structvres.
- li. A fugitive dust control plan shall be submitted to the
Environmental Health Department for review and approval prior
to commenaement of construction. At a minimum the plan shall '
. address the watering of disturbed areas, watering of dirt and �
� rock prior to removal, the daily cleaning of adjacent paved �
� roads to remove mud that has been carried out, and speed ;, b
� limits or other measures necessary to prevent windblawn dust
from causing a nuisance.

# 12. Construction shall be ].imited to weekdays during the hours of „
� 5:00 a.m to G:00 p.m. on portions of the trail which cross �
} private property and 7:0o a.m, to 7:00 p.m. on portions oE �:_;

� submit proof of water Quality Certification from the Colorado �,,
Department of Health in accordance with the Clean Water Act "

� 14. Prior to commencement of construction, the appZicant shall

for all final development proposed in the Highway 82 right- p':

15. All driveway crossings shall be clearly marked and signed. �
y� 16. AZZ aspects of trail design shall comply with Pitkin County
Trail Desiqn and Construotion Standards and the Pitkin County
Sign Code.

. 17. Trail lighting shall be prohibited.
�r 18. Revegetation shall begin immediately upon completion of
construction.
` i 19. In the event that parking facilities become necessary to
accommodate trail use, said facilities shall be subject to
1041 and Scenic Overlay Review. Parking shall be pYOhibited
in the immediate vicinity of the Stillwater Bridge.
20. The Open Space and Trails Board shall make every reasonable ,
ef£ort to mitigate the visual impact of the trail on the
�,,,, . residents of the Shadowood Apartments.

.z' 21. All material representation made by the applicant in' the
application an8 in public meetings shall be adhered to and
considered conditions of approval, unless amended by
subsequent conditions.
