RECITALS

1. Pursuant to Section 3-1903 of the Land Use Code, Hard
- Rock America Corporation (hereinafter "Applicant") requests
approval of a temporary use permit from the Board of County :
Commissioners (hereinafter "Board").
2. The temporary use permit shall accommodate a special -
event benefit including a 5 mile run, a 7 mile bike race or
duathlon, and a concert. The event is to be held between 9:00
. ��� � AM and 5:00 PM on August 7, 1994 at the Tiehack Buttermilk Ski
- Area.
3. The temporary use permit shall also accommodate use of
the 23.94 acre site owned hy Buttermilk Associates (ajk/a
-- - Stapleton property), immediately west of the main Buttermilk -
Ski Area Parking Lot. The applicant proposes to use an area
-- no greater than one acre in size to accommodate overflow
parking. =

iNOW, THEREFORE, BE ZT RE80LVED by the Board that it hereby
qrants Hard Rock America a Temporary Use permit to accommodate the
above described special event subject to the following conditions:

1. The Applicant shall contact property owners in the immediate
vicinity of the Tiehack Buttermilk base area that may be
affected by impacts associated with the race, such as noise
and traffic, These property owners shall be informed of the
- `:r•:� date, time and duration of the event.
2. The Applicant shall provide proof of insurance for the event,

to the satisfaction of the County Risk Manager.
'�` 3. The Apglicant sha11 obtain a variance from the Pitkin County
Noise Ordinance.

� 4. This temporary use permit is issued to the Hazd Rock America
Corporation for a benefit event to include a 5 mile run, 7
mile bike race or duathlon, and a concert to be held on August
.� 7, 1994 from 9:00 AM to 5:00 PM at the base area of the
4 Tiehack Buttermilk Ski Resort. Music shall be limited to the
hours between 11:00 a.m. and 3:0o p.m.
5. All parking associated with the event shall be limited to the
Tiehack Buttermilk Ski Resort parking lot with the exception
that overflow parking may be accommodated on up to one acre .

5. Grass/vegetatzon on the Stapleton parcel shall be mowed no
more than two days prior to the event and shall be wet-down

7. Signs advertising the event shall meet the sign regulations
in the Pitkin County Land Use Code.
I 8. Plans for any temporazy structures shall be reviewed and �t-1
approved by the Aspen Fire Marshall. i�=
