RECITALS
� 1. The Rubay Estate Trust, hereinafter "Applicant", has
applied to the Board of County Commissioners of Pitkin County,
` � Colorado, hereinafter "Board", for approval of a caretaker
r�;: �;
dwelling unit pursuant to Section 3-8.13(d) of the Land Use
Code and for approval of an insubstantial change to a recorded
plat to establish an accessory lauilding envelope' for a
garage/caretaker unit, pursuant to Section 4-2.1�� (b) of the
Code.
� = 2. The Applicant's lot is zoned R-30 and is approximately _.

6.4 acres in size.
3,' Said parcel is described as Lot 2 of the Rubey Estate
,' � Subdivision; located on Lower Red Mountain.
`"�' 4. The Applicant proposes to deed restrict the caretaker
`� '� dwelling unit pursuant to ordirance 91-11.
5: The Board heard this application at a regularly scheduled -
meeting on July 12, 1994, at which time evidence and testimony
was presented with respect to this application.

hereby grant approval to the Rubey Caretaker Dwelling Unit and
Insubstential Change to a Recorded Plat application subject to the
following conditions:
- : I 1. The Applicant shall submit a signed and recorded caretaker
� unit deed restriction, and floor plans of the caretaker unit
�•. � to the Housing office, prior to the issuance of a huilding
� permit.
`.-j2. The caretaker dwelling unit shall be limited to 700 square
I feet of net livable area.

� 3. The Applicant must obtain a Tap Permit from the Aspen
, � Consolidated Sanitation District, prior to the issuance of a
� building permit.
.;� 4. The Applicant shall submit construction drawings of the
proposed garage/caretaker unit to the Aspen Water Department,
depicting: the actual location of the existing water lines;
.: t .grading details for the proposed driveway and garage; and the
t'� location of the new water service line for the proposed
caretaker uniC, prior to the issuance of a building permit.
� � 5. The Applicant shall submit a 24"x 36" mylar plat amendment map
y�� to the Plannin Office a
g pproval and recordation. This plat
shall be submitted, prior to the issuance of a building permit

for the proposed caretaker unit/garage.
' 6. The Applicant shall submit plans for an engineered foundation .
for the proposed qarage/caretaker unit, prepared by a
qualified structural engineer, prior to the issuance o£ a
building permit.
7: The Applicant shall adhere to all material representations
- made in the application and in the public meeting. i
