� RECITALS

1. The Pitkin County Boazd of County Commissioners("BOCC") recognizes that
Q the legal issues concerning the construction and removal of the Morgan cabin(the "Cabin")
. have proceeded to litigation,and the Pitkin County Discrict Court has issued orders conceming
these matters which are binding to all parties including the BOCC and the owners of the Cabin,
, Michael Morgan and Diedre Morgan("the Morgans"). ,
2: The BOCC recognizes that the Morgans have failed to remove the Cabin as
ordered by the Court and that the BOCC may now take steps to remove the Cabin at the
( Morgan's expense.

� NOW, BE TT RESOLVED, that Pitkin County will not take action before August 1,
1995 to remove the Cabin provided all of the following conditions are complied with by the
� Morgans:
� � (a) The Morgans must post a bond acceptable to the County Attomey's Office �
� in twice the amount of the removal costs of the Cabin by the date of August 26, 1994.
� (b) The current locks on the structure must be changed a[ the Morgan's
� expense by August 26, 1994. The Morgans must pay this expense by August 26, 1994. The
� locks will be controlled by the County exclusively.

�", (c) The Morgans must pay their back Planning Office fees and Court Costs ,
,��' by August 26, 1994 consisting of$1,820.00 and interest at eight percent(8%)per annum of �
r $186.20.

— � (d) The Morgans must conduct a Pre-application Interview with the Planning ,
Office and pay Planning Office fees for a new application for a 1041 and General Submission
� Approval of a residential siructure for the property. Said Pre-application Interview is to be
';� completed no later ffian August 26, 1994 or at a date chosen by the Pitkin Counry Planning
, . Office. .

�;, (e) The Morgans must pay for the cost of inspection of the Cabin between _
`-? ' the present date and.the removal of the Cabin. This inspection will be conducted by Pitkin
r; County personnel. These costs are to be paid on a montlily basis. Failure to make cunent
: payments shall constitute breach of these conditions. �
' (� The Morgans must remove the Cabin af his sole expense by August i, E ��

�'� (g) The Morgans must remove all personal property from the Cabin by August ,;;
� 26, 1994 including furniture belonging to Dr. Harold Whitcomb. !`__�!'-
° (h) The Morgans must submit a complete application for 1041 and General T�i
Submission Approval for a residentiai structure by September 15, 1994. The total estimated

n Planning Office Fees for processing said application must be on daposit with the Planning OfFce ',''r'
� on or before September 15.
� . {i) The Morgans and Dr. Harold�Whitcomb, the owner of certain personal '
r property contained within the Cabin, are to sign an agreement with the County acknowledging f -
� that the violation of any condition of ttvs Resolution shall give the County the right to act �;�_;:
immediatety to remove the Cabin at owner's expense and without further notice to owner. ti
� Failure to enter into an agreement aclwowledging same by August 26, 1994 shall also.give �_.
Pitkin County the right to immediately remove the Cabin. Said agreement shall include owner's
aclrnowledgment.that the Cabin was built illegaliy and that owner has failed to remove the ��
,� Cabin. T'his separate agreement will be executed by August 26, 1994.
� (j) Owner will not enter upon the premises at any tune without County's
written permission between August 26 and the tear down of the Cabin. Any such entry shall
' � be considered a breach of the agreement.
�
' � (k) The Morgans will sign a full waiver of any further appeal rights they may
� have in any litigation with Pitkin County by August 26, 1994.
