� OPPOSING THE PROPOSED BALLOT QUESTION KNOWN AS AMENDMENT 12 (=^: .
j TO THE COLORADO STATE CONSITUTION

4 RF�CTI'ALS
1. A proposed amendment to the Constitution of the State of Colorado is on the
s[atewide ballot for the November 8, 1994 election and is designated as Amendment 12.
� 2. If passed, Amendment 12 would supersede and thus remove a number of
° provisions of the Colorado State Constitution, certain state statutes and counry ordinances
� without disclosing and identifying the laws to be removed,and any such removed law,however
" desirable it may be, could not be reenacted without a statewide vote. This would reduce local
� control of local govemment.
� 3. If passed,Amendment 12 would sharply reduce the number of signatures required
� for petitions for ballot propositions (initiatives, referenda, and recalls). In Pitkin County the �
number would be reduced from 1,454 to 182. The Amendment vvould require all such petitions
� to be printed and duplicated at County expense, would eliminate from each petition a year or
,z �j any mention of Pitkin County, would allow signatures which are nicknames or initials, or
abbreviations, would not require a street or avenue or apartment listing,and would not include '.
� ` a zip code. Upon filing of s¢ch a petition the County Clerk would be barred from ascertaining
� whether the signers are registered voters in the County.
4. Under Amendment 12, petitions for initiauve and referenda could be filed not �
� only with the state and with certain counties,cities and towns,but also with every governmental
entity, including all special districts and authorities and commissions, thus increasing the
number of jurisdictions afFected from 267 to 1,974. Moreover, such petitions would not be
limited to legislative matters(laws)as now,but would extend to every detail on which action
is or could be taken.
5. Under Amendment 12,an ordinance,resolution,or other administrative decision ,
, y (i.e., building permits, etc.)adopted by the County would not become effective until 91 days
after it is published, and the filing of a petition for a referendum before the publication could ° '
postpone the effective date of the ordinance, resolution or other administrative action, for as -
much as 21 additional months.
6. Under, Amendment 12, a small number of people would be able to put dozens ��.:'
of questions on every ballot and could force people who want or need to rely upon a County ! :���-
, action to wait as much as two years, and in some circumstances, forever. � '='-

;� 6. Under Amendment 12,a candidate for public office could not accept a campaign
� contribution of more than $50 from a corporation or a labor union or a political act�on
committee, but there is no limit on the amount which an individual person can contribute and ;,
� no limit on the amount which a candidate could raise and spend. The result would be that small } �
� numbers of persons making very large contributions could have inordinate influence on

candidates. Moreover, the names of these large contributors and the amount each contributes
would be kept secret from the public.

7. If passed, Amendment 12 would permit recalls of judges. To subject a judge to
a recall based on a temporary adverse public reaction to a decision he rendered is to destroy `
an essential element of the American democratic grocess - a judiciaty which appties and 4:'
enforces the law with objectivity and impartiality,which protects our individual Constitutional -
rights even against the wishes of the majority, a�which does not decide cases according to -
the winds of public opinion.
NOW THEI2EFORE BE IT RESOLVED by the Board of Counry Commissioners of
Pitkin County, Colorado, having considered and weighed the terms and implications and
potential consequences of the proposed amendment of the Constitution of the State of Colorado
�'+` - which is designated Amendment 12 on the statewide ballot for November 8, 1994, the Boazd
opposes tbe adoption of Amendment 12 as contrary to the interests of the public of Pitkin
_ County.
