dl i. The Pitkin County Board of Connty Commissioners has worked.with the Town
'� of Snowmass Village and the Aspen Skiing Company over the last hwo years to identify an
�� appropriate midgation strategy to help offset the impacts of development of Burnt Mountain.

, � Snowmass Viitage in accordance with our 1984 Intergovernmentai Agreement which pmvide
. � the County with the abiliry to submit reasonable and binding mitigation to any approval of ihe
� proposal issued by the Town of Snowmass Village.
� 3. The Town of Snowmass Village failed to include over half of these mitigauon conditions
and, in fact, failed to include any that were not conditions inctuded by other parties.
4. Recent attempts to avoid lirigation and�gotiate a settlement have been unsuccessful. i

NOW T'HEREFORE BE IT RFSOLVED by the Board of County Commissioners of �
� Pitkin County,Colorado that the Board directs staff to file the litigation which staff was d'uected
��` to prepare last week in a timely manner.
