ACCEPTiNG PRIVATE CONTI2IBUTIONS TO FURTHER .
� THE SAFE OPERATION OF THE PITKIN COUNTY AIRI'ORT �,.

- ItECITALS
�_, WHEREAS, the Federal Aviation Authority and the County of Pitkin("the County")have been
engaged in a prolonged dispute regazding the County's long standing.safety and noise regul2tions �-
(the "Sazdy Field Regulations"), which prohibit private aircraft from using Sardy Field from
one-half hour past sunset to 7:00 a.m.; '
� WHEREAS, the Sazdy Field Regulations were designed to protect the citizens of the County
potential airport aser and passengers fram the significant health and safety risks that would result
from allowing unrestricted private aircraft to use 3ardy Field during the proscribed period;and
WHEREAS, the County did not possess suffccient financial resources to adequately defend the
Sardy Field Regulations.
NOW,THEREFORE,BE IT RESOLVED,by the Boazd of County Commissioners,County of
Pitkin, State of Colorado, as follows:

.k= L The County was forced to consult with, retain, and hire vazious legal and technica[
professionals{the"Professionals"),including attomeys and air safety specialists,to assist
the County in defending the Sazdy Field Regulations.
2. The County did not have su�cient financial resoarces to pay the fees and/w salaries of �
the Professionals.
;; 3. Don Henley, a home owner of the County, has personally donated$357,971.05 to pay
_ : the fees and/or salaries of the Professionals for services performed in connection with
the County's defense of the Sudy Field Regulations. These services ultimately resulted .
in a compromise which included substitute Congressional Legislative restcictions which 7 `
accommodated many important safety and noise concerns of the County,its citizens and
� airport users and passengers.
� 4. Dwight R.Sheliman,Jr.,an attorney with offices located at 0191 Woods Road,Woody 4�'
Creek, Colorado 81656 and a resident of the County, and his law firm, Shellman & � �;:
� Ornitz, P,C. acted as professionals at hatf their ordinary bitling rates. T'hey also have y � �-
� � donated in excess of$64,000,00 in legal fees and expenses to the County to assist the � �'.
M County in defending the Sazdy Field Regulations. �,;

� b. The Professionals were not consulted, hired and/or retained for the personal benefit of �
Don Henley, Mr. Sheliman,or Shellman&Ornitz,P.C.,nor did they receive a benefit �; '
� of any other nature from the Coanry in return for theu donations. `

7. Don Henley will not be reimbursed by the County for the fees and salazies he has paid
the Professionals, nor has he sought reimbursement from the County. t

S. Dwight K. Sheitman, Jr. and Shellman&Ornicz, P.C. will not be reimbursed by the
County for the services they have donated to the County, nor have they sought
� reimbursement of this$64,000.00 from the County. . ;

Henley, Dwight K. Shellman and Shellman&Ornitz, P.C.
