�tis3. RECITALS
��� 1. The Colorado Department of Transportation, hereinafter
"Applicant", has applied to the Board of County Commissioners
� of Pitkin County, Colorado, hereinafter "Board", for approval
of a Special Review Use Permit for the continued operation of
the Independence Pass Gravel Pit, pursuant to Section 3-20 of
the Land Use Code.
2. The site is zoned AFR-10 and is approximately 1.5 acres
,.,� - in size. ,

3. Said site is located 12 miles southeast of Aspen on
Highway 82, 100 feet north of the Highway, in the NE 1/4 of
. Section 2, Township 11 South, Range 83 West, of the 6th P.M.
= 4. The Planning and Zoning Commission recommended approval
of the Special Review Use Permit at the September 27, 1994 -
regular meeting.
� . 5. The Board heard this application at a regularly scheduled
� meeting on December 6, 1994, at which time evidence and
� testimony was presented with respect to this application. ���

6. The Board determined that the proposed development meets 1

i',+ NOW, THEREFORE, SE IT RESOLVED by the Board that it does

'; hereby grant a five (5) year Special Review Use Permit for the '
� -:; Independence Pass Gravel Pit operation, subject to the following �� .

� - conditions:

� l. The S ecial Use Permit shall be
p granted for a five year period
� lasting from January 1, 1995 through December 31, 2000.
Pursuant to Section 3-20 of the Land Use Code, the following
� shall apply: •
' _'� The Applicant annually submit a statement which demonstrates
k the continued conformance of the use to the conditions of the i
Special Use Permit to the Planning Director. If, after �
reviewing the statement, inspecting the site and considering
any other relevant information, such as odor or noise ;
complaints, the Planning Director determines that the use is
not in aonformance with the provisions of the Special Use '
Permit or creates unanticipated impacts, the Planning Director �.
shall recommend to the Board that it consider withdrawal of ;�
such ermit ursuant to a dul noticed ;
P � P y public hearing. The
statement shall be annually submitted to the Planning Office i-
.�`�,� 45 days prior to the anniversary of approval by the Board of �
County Commissioners. i
2. Quarrying of the subject site shall not be allowed under this •
, approval. � .
3. Use of the site shall be subject to all provisions of the
Special Use Permit issued to the Applicant by the U.S. Forest
- - Service (Exhibit A attached).
4. All batch plant operations shall be contained within the
� already disturbed area of the Independence Pass Gravel Pit
. ._. �,�. site. S
� .
� 5. Parking associated with operations on-site shall be contained �
on-site behind the existing trees, so as to screen parked 1
[ vehicles from view of Highway 82. '
y 6. Drinking water shall be provided from a source approved by the �.�'
� Environmental Health Department and provided in approved and + '��'
� sanitary containers. _ ��
� 7• On-site sewage disposal shall be provided thraugh the use of '
portable chemical toilets. Any other sewage disposal system �.. ,`'�
shall be subject to the issuance of a Permit from the :j;:;?'!
Environmental Health Department.

�� 9. Air pollution mitigation shall be provided in the following

�y A. Any concrete batch plant or hot mix plant used on the
' �a site shall be permitted prior to operation by the
� Colorado Department of Health and reviewed and approved
by the Environmental Aealth Department. Said plants
_ shall have valid Colorado Air Quality Control IInissions _
� Permits prior to operation. The Applicant shall provide
� copies of the plant and air quality control emissions
� permits to the Environmental Health Department, upon
, receipt of same.
;� � B. A dust control program for maintenance of the access road
to the site shall be approved by the Environmental Health
Department prior to the commencement of any activity on-
� site. :
� C. Any mud carry-out from the site on to Highway 82 shall •
be removed by the Applicant as needed on a daily basis.
- --- 10. There shall be no utility extensions to the subject site.
- 11. Erosion mitigation shall be as follows:

� �?� A. Work shall be scheduled to expose areas subject to
,� erosion for the shortest possible time, and natural �
;� vegetation preserved to the greatest extent practicable. "
� Temporary storage and construction buildings shall be
z� located, and construction traffic routed, to minimize
� erosion. Temporary fast-growing vegetation or other
� suitable ground cover shall be provided as necessary to •.

� � B. The site shall be reclaimed pursuant to the Highway
N Department Mined Land Reclamation Permit (Exhibit B 1

. ,�� 13. In order to mitigate noise impacts, batch plants shall be set � =
±� back approximately 25o feet from Highway 82. �.
� 14. Operation of the batch and hot mix plants shall be limited to
the hours between 7:00 a.m. and 7:00 p.m., Monday through
�, . Friday, except in case of an emergency.

� 15. The housing of employees shall be prohibited on-site.
16. The App2icant shall take reasonable precautions to prevent
pollution of or deterioration of lands or waters which may s •
result from the exercise of the privileges extended by this
permit. In particular, the Applicant shall, at all times
comply with applicable local, State and Federal requirements
for pollution abatement. Failure of the Applicant to so comply
may result in termination or suspension of this permit.
17. Storage of recycled asphalt or materials containing salt shall
be prohibited on-site.
1s. All material representations made in the public hearing and .
in the application shall be adhered to and considered as
conditions of approval.

layout, construction, reconstruction, or alteration of improvementa on the
permit area, as we12 ae revisione of such plans, cmcst be prepared by a 2iaenaed
- eagineer, architect, and/or landscape azchitect. Such plans muet be approved in
writing by the autharized officer or a desigaated representative beEore the
___ _ commeacement of aay work. A holder may be required to furnish as-built plans, .
" maps, or eurveya, or other similaz information, upon completion of
construction.

' B. Haintenance. The holder ahall maintain the improvements and pezmit area to �
� � standards of repair, orderlinese, neatness, sanitation, and eafety acceptable to i
