pursuant to the authority of the Colorado Department of HeaZth and
include not only basic services which are to be provided by all q +
local health units organized under the Colorado revised statute CRS ' �
� 25-1-501 through 25-1-516 (COUnty and District Health Departments) �
� and CRS 25-1-601 through 25-1-667 (Local Board of Health), but also
� those optional services deemed basic in Pitkin County.
� WHEREAS, the County is by statute authorized to provide basic {, ,.
� and optional services to the residents of Pitkin County subject to

Provide a system of health services designed for ��
the preven�ion, early detection, treatment and
follow-up of childhood diseases, including
- ' metabolic disorders, handicapping conditions and �
birth defects; counsel and teach basic nutrition, +'
fluoride supplementation: provide appropriate
_ follow-up for children with health problems. +�
Proqrams included are Child Protection Team, SIDS
(SUdden Infant Death Syndrome), EPSDT {Eazly ;'.
Periodic Screening, Diagnosis and Treatment),
, Handicapped Childrens Program, WIC (Women, Infants ,'
and Children) adolescent health projects, preschool
and private school screenings.
b. �taternal Health. Provide medical, nursing, socia2,
nutritional and educational services during prenatal and
postpartum periods to reduce the risks of adverse outcome "
of pregnancy. Prenatal Clinics will be held at least once a
weekly. �

cancer, diabetes, hypertension, substance abuse testing, �:j+
I public health lab services, disaster planning and '�
emergency response team.
e. HPa'1th promotion and Educa�ion. Provide effective
- comprehensive health promotion and education services
which will result in a reduction of preventable diseases,
injuries, premature disability and death and provide #or
the attainment of a higher level of health an8 life �
quality. The service will:
'`� . i) identify and dissea�inate information concerning
existing community health and health related
� programs and resources;
ii) identify unmet health education needs;
iii) provide technical assistance in program design and
E evaluation to community programs;
� iv) provide direct health promotion and education
- - services and programs to se2ecE populations

B. County agrees to purchase these services for the following �.
targeted groups: Low income residents of Pitkin Connty, F _,i
transient or permanettt, including visitors, and the � _
communities of Redstone and Lenado. (Low income is defined as
150$ of poverty level and these people pay less than 25� of
cost of services.) County additionally-agrees to pay the cost _
of AIDS publications required by the County Health O£ficer. 5:.,�

� Contractor shall: �

? 1. Strictly adhere to all applicable federal, state, and local �
1 laws or regulations (including County Procurement Code) that ��:
have been or may hereaftex be established. �
� - � 2. Hold aad maintain for the term hereof the necessary licenses
and certifications as specified under State law which permit y
the perfornance of the services to be purchased herein.
3. Maintain a sliding-scale fee schedule for its
services in order to accomodate low income individuals. ;•,_;,
4. Utilize subcontractors who shall be subject to the �.��`
` .� requirements of the Contract as listed here, and be i.
responsible for the performance of any subcontractor.
5. Abide by all applicable provisions of the Title VI and VII of
the Federal Civil Rights Act of 1964, Section 504 of the
RehabiZitation Act of 1973, and Title XX of the Social � ;i�
Security Act of 1975 as revised.
6. Maintain written requirements for safeguarding client
information and comply with said requirements.
7. Tndemnify County and the State of Colorado against any �r
-- Ziability and loss against all claims and actions based upon
or arising out of damage or injury, including death, to
persons or property caused or sustained in connection with the I,�
performance of this contract or by conditions created thereby, a'
� _ or based upon any violations of any statute, ordinance, or
4 regulation and the defense of any such claims or actions; < •
1 maintain insurance in such types and amounts as are necessary ;■
to fund this indemnity; provide proof of such insurance to the
� county upon demand therefor. ��
8. Maintain service program records, fiscal rewrds, documenta- ��
! tion and other records relevant to this contract for a period
I of five years. The above shall be subject at all reasonable �}
times to inspections, review or audit by Federal, State or

1. The Parties to this contract intend that the relationship ''`;" •

employer-independent contractor. No agent, employee, or ,;.

� servant of Contractor shall be deemed to be an employee, ;:',,::?;
1 agent, or servant of County. Contractor will be solely and r;L;
entirely responsible for its acts and the acts of its' agents,
! employees, servants and sub-contractors during the performance �¢,'-.;
+ of the Contract.
i 2. Payment pursuant to this Contract, if in County, State, or �i��
' Federal funds, whether in whole or in part, is subject to and
. contingent upon the continuing availability and appropriation -�
of County funds for the purpose thereof.
3. This contract constitutes the full and complete agreement of
the parties and supercedes or incorporates any priar written
and oral agreements of the parties. In addition, contractor
understands that no County official or empZoyee, other than
the Board of County Commissioners acting as a body at a Board �`"4�`
meeting, has authority to enter into a contract or to modify
� the terms of this contract on behalf of the County. Any such
l contract or modification to this contract must be in writing
� and be executed by the parties hereto. :
4. Either party shall have the right to terminate this Contract ' '+..
by giving the other party ninety days notice by registered
mail, return receipt requested at the addresses below listed, �:
effective upon mailing. If notice is so given, this Contract
-_- shall terminate on the expiration of the ninety days, and the ,
liability of the parties hereunder for £urther performance of
the terms of this Contract shall thereupon cease, but perform
i their ob].igations up to the date of termination. The County's
f contact person for this contract shall be the Human Services �d'

� 5. In the event this Contract is terminated, final payment to the ;
( Contractor roay be withheld at the discretion of the County
until final audit. Incorrect payments to the Contractor due ��

from the Contractor by deduction from subsequent payments
under this Contract or other contracts between the County and �i
