WHEREAS, the Owner has submitted to the County for approval,execution <�� �
_ and recorda[ion a Final Plat(the"Final Plat")of the Castle Geek Banks Lot Split �!.' = '
i `�i PUD/Subdivision(the"Subdivision"),encompassing Ehe real property described in ;.� -
Exhibit"A"annexed hereto and made a part hereof(the"Property"),and also �;_
described on the Final Plat which is recorded in Plat Book �' at Pager��t the �;„
, � real property records of Pitkin County,Colorado;and

WHEREAS,the County has fully considered the Final Plat,and is willing to
grant approval of and execute the same upon the Owner's agreement to certain �
obligations,including,among other things, the granting of the fishing easement
' contained herein. 'i`.�

NOW,THEREFORE, in consideration of the mutuai covenants herein
contained,the parties hereto agree as follows: �

� 1. EasemenE. The Owner hereby grants to the County for the benefit of
the public at large a perpetual,non-exclusive easement(the"EasemenE") for the
_ �if� purpose of fishing in Castle Creek. The Easement shall extend outward five feet(5')
� horizontally from the high water mark of Castle Creek,wherever Castle Creek
�'�':i crosses the Property.
$ 2. Sco�e of the Easement. The easement shall be used solely and
-'.:i exclusively for fishing along the course of Castle Creek. Nothing contained herein
"' shall be construed to grant an easement ac2oss any o£the remainder of the Property, �
� or across any other property owned by the Owner,for access to Castle Creek or
otherwise. The grant corttained herein shall be strictly construed. [
3. No Interterence. The exercise of right granted hereunder shall not
� � unreasonably interfere with the use of the property burdened thereby.

� 4. Maintenance. Indemnity and Insurance. By granting the Easement,the `
� , Owner shall have no obligation to repair,clear or otherwise maintain the area �
'! within the Easement,including,without limitation,the banks along Castle Creek (
within five feet(5')of the high water mark,or to insure or indemnify the County ' '
for any injury,daim or damage to any person or property,whether alleged to have �: �,��•.

5. Enfire Agreement. This Easement contains the entire understanding � '

� 6. Captions. The captions in this Agreement are for convenience only `
