into a concract which provides for grant funds ro be made avaitable to the Pitkic► Counry -•(
1 3heriff's Department for a re-validation srudy of the Standardized Field Sobriery Tests; and
'WHEItEAS, the above described contract allows for subcontract labor for the purpose .'"•
of furthering the goals of ihe re-validation study; and � ,

Transportation afety and the Couary of Pitkin, for the use and benefet of the Pitkin County
Sheriff's Office,a copy of which is attached and incorporated herein. The parties here[o agcee

STATEMENT OF WORK TO BE PERFORMED BY SCRI �'
--. SCRI sha(I provide the professional and technical persownel required to perform the {
' Conaact Objective Plan tasks 17-053,17-05.4 and 17-05.5 as described in the attached contract ;. ;
between CDOT and Pitkin County. �.,

SCRI shall provide approximately 1,550 person hours, professional and technical � '-
combined, toward the completion of the work described above.
SCRI shall assign Marcelline Burns, P.h.D. and such data proeessing personnel as � ;,::
required for the completion of this work. Dr. Burns will act as the Project Scientific t
Investi ator and will artici ate in the overall mana ement of data collection and wifl be �'` ��"

` professional canferences and published in appropriate.journals. The deadline for the ,

j Department shall be no later than November S, 1995. Also inciuded with the final report shall 1 ;:
I be a final claim for all costs incurred by SCRI not previously reimb�rsed. f : f
— PAYMENT FOR SERVICES FROM PTTKIN COUNTY TO SCRI �•:����w: ,

In exchange for the compietion of the projects described above, Pitkin County agrees
to compensate SCRI in the following manner:

1. The total grant amount for personnel serJices, operating expenses, capital �;���f i"
equipment and travel expenses is Sixty Thousand, Three Hundred, 'Thineen Dollars ;;��� '
($60,3I3.00). SCRI witl bill Pitkin County at an hourly rate of$39.59 for Project Sciendfic '
Investigator services and$14.$6 for data processing services. '�
' i 3. All expenses, personnel, openting,capitol equipment,and travei,not to exceed
a tota! of$60,313.00, are reimbursable. SCRI agrees to make the initia[ expenditures and :�;
submit invoices and receipts for reimbursement to the Pitkin County Sheriff s Offtce, to the ,r
attention of E[ten Anderson, Grants Administraror. Reunbnrsemen[s are made on a quarterly
. basis beginning April 20, 1995. SCRI shall submit invoices and receipu ten days prior to the ?`'
- quarterly deadline. Reimbursement will be made by the Pitkin County SherifFs Office to SCRI
immediarely after receiving payment from the Colorado Depaccment of Transportation, which �
funds the projects oudined in this Agreement. �-
. CANCELLATION OF AGREEMENT '��
. �� The County reserves the right ro cancel this Agreement for unsatisfactory performance
of the requirements herein or the lack of services provided by SCRI as determined by the
County, by giving written notice, by firsi class mail at the following address:

The parties hereto expressly recognize SCRI is to be paid, reimbursed, or otherwise •,i .
compensated sotely with State funds provided to tke County for the purpose of re-validating the -
, correlation between standard'ued fieid sobriety tests and btood aicohol content. Therefore,
SCRI understands and agrees all its rights, damands and claims to compensation arising under
this Agreement are contingent upon receipt of such funds by the County. In the event such
funds or any part thereof are not received by the Counry, the Counry may unmediately : :,=;
terminate or amend this Agreement.

I damages to itself and third parties and to all real and personal property occasioned during the ` y'

_ The Contracror shall perform iu duties hereunder as an independent contractor and not
_-._.-.___ as an employee. Neither the Contractor nor any agent or employee of the Contractor shall be,
or shall be deemed to be, an agent or employee of Pitkin County, and they shall have no Sir �;
• authorization,express or implied,to bind Pitkin County to any agreements,settlement,liabiliry,
or understanding except as expressly set forth herein. The Contractor shall be responsible to , ,
the State for the uldmate results of performance required hereunder but shall noi be subject to
the direction and control of Pitkin County as to the means and method of accomplishing the
resulu. The specifications in this Agreement of particular performance standards Piticin Counry
deems essential to proper performance and Agreement value shall in no event be deemed to .r. ;
alter this rela6onship. Contractor shall pay when due all required employment taxes and !
income tax withholding,including all federal and State income tax on any moneys paid pursuant �
' to this Subcontractor Agreement. The Contractor shall provide and keep in force worker's
compensation(and show proof of such insurance) and unemployment compensation insurance
in the amounu required by law, and shall be solely responsible for the acts of the Contractor,
' its employees and agents. The Conuactor acknowledges that Contractor and its employees are
` 'i not entitled to the benefit of worker's compensation insurance or unemployment u�surance
unless the Contractor or a third party provide such coverage and that Pitkin County does not
pay for or otherwise provide such covenge.

funding for implementation of its Fiscal Year 1995 Highway Safety Plan(HSPJ from the tJ.S.Department
of Transportation, National Highway Traffic Safety Administration;and ��i
WHEREAS, the HSP contains programs and activities which the State has determined, in '
accordance with applicabte criteria,are designed to reduce the frequency and severity of alcohol and '
other drug related traffic crashes or improve the operafional e�ciency of existing tra�c safety programs
regarding the alcohol and drug impaired driver in Colorado;and ''
