Resolution No. 93- �� '��:;i;. �i;= . RECITALS 1�- 1. Section 2-24 Compatibility with Adjacent or Nearby Public �„; i Lands, states that it is the policy of the County to preserve and ��'`'` protect public lands from the impacts of incompatible development. � s,..,. ;; 2. Section 2-24.2 further states that it is the policy of ' the County to avoid development that will encourage the intrusion of roads or high levels of human activity on such lands. :?� ' �- 3. These policies provide direction as to the County's _ position on development in areas which are considered rural and ',:�-�^ remote, however, they are not presently accompanied by specific ��' regulations in the Land Use Code. ;j 4. The Richmond Hill/Little Annie area contains character and resource qualities which require protection under the r yx provisions of Policy 2-24 and other policies and regulations of the : Land Use Code. t � 5. The Pitkin County Land Use code does requlate development in this area under the provisions of Section 5-400, Division Four - -� Areas and Activities of Local and State Interest and Section 6-3, � General Submission. 6. After extensive review o£ rural and remote issues by the �� Planning and Zoning Commission and the Board of Covnty . -`� Commissioners, the Board of County Commissioners is preparing to � � enact comprehensive legislation in respect to this area. The ' � - � processing of applications in this interim period would compromise ` the effectiveness of this effort. i i ��' ; 7. The building permit for restoration/reconstruction must be issued within one (1) year (12 � E months) of the date of demolition or destruction, whichever is , ` first. The Board may approve an extension to the one year `s' deadline. The proposed building reconstruction/restoration must conform in terms of use, number af dwelling units, configuration `��° ;:'Fyjs. and area and bulk to the building which was partly or fully i;;,j�;�- demolished or destroyed. The reconstruction/restoration may include insignificant modifications to the original design if the Planning Director finds that such modifications are necessary to allow the use or structure to meet basic life, health and safety standards of the Building Code. The Board of County Commissioners [ ,� may permit other modifications to the restoration/reconstruction j '� of a non-conforming structure, not authorized by the Planning �. Director, subject to the following standards: ;;� A.
