I 1. Pursuant to Section 3-8.11 of the Land Use Code, Hard

Rock America Corporation (hereinafter "Applicant") requests �,

approval of a temporary use permit from the Board of County
4 Commissioners (hereinafter "Board"); and
� 2. The temporary use permit shall accommodate a special
event benefit including a 5K run, a 2oK bike race or duathlon, �� :�'>�'.'''h
and a concert. The event is to be held between 8:00 AM and � t

8:00 PM on AUgust 7, 1993 at the Aspen Highlands Base Area.

3. Food and beverages, including alcohol, will be served

ii during the event. The Applicant has not obtained a special

_� event liquor license, however, alcoholic beverages may be
served under the liquor license issued to the Schwanee's ''•

�� a establishment. The Applicant is subject to all restrictions

identified in the schwanee liquor license.

i 4. The Board considered the applicants request at a public

meeting on July 27, 1993, at which time, Staff verbally .�,1,

; presented the applicants request and testimony was heard from �';;

! NOW, THEREFORE, BE IT RESOLVED by the Board that it hereby �i:�° .

1. Fire access to existing structures on site shall remain open ;,•� -

2. The Applicant shall contact property owners in the immediate "`'`'
+ vicinity of the Aspen Highlands base area that may be affected zr'-`
� by impacts associated with the race, such as noise and �� •i
' traffic. These property owners shall be informed of the date,
, I time and duration of the event. ;

� 3. The Applicant shall provide proof oP insurance for the event, ';:ti�,
� to the satisfaction of the County Attorney.

{ 4. The Applicant shall obtain a variance from the Pitkin county .
Noise Ordinance.

5. This temporary use permit is issued to the Hard Rock America
Corporation for a benefit event to include a 5K run, 20K bike
p race or duathlon, and a concert to be he2d on August 7, 1993 ;;.£
s, from 8:00 AM to 8:Q0 PM at the base area of the Aspen n`=�`-
Highlands Ski Resort. `"`���
� 6. All parking associated with the event shall be limited to the
r Aspen Highlands Ski Resort parking lot. Parking shall be
prohibited on Maroon Creek Road.
_ 7. Signs advertising the event shall meet the sign regulations
a in the Pitkin County Land Use Code. �
'� 8. Plans for any temporary structures shall be reviewed and Y
�• approved by the Aspen Fire Marshall. ;,
� ,
�. '� 9. The applicant shall comply with the Temporary Food Service �!
�� Guidelines published by the Pitkin County Environmental Health
- Departaent. ,
