' Tale Productions {hereinafter "Applicant��) requests approval
��
of a temporary use permit from the Board of County ? �=�`

j Commissioners (hereinafter '�Board"); and

2. The temporary use permit shall accommodate the filming � .1,. ,

of the motion picture, "Tall Tale" on three sites within
t Pitkin County; and �`�

�; 3. The filming shall occur over a period of approximately
� three weeks on or about September 12th through October 7th;

�i 4. Filming shall be staged at the Filoha Meadows and �.
� Greenwald sites in the Crystal River Valley between
� approximately September 12 through September 24 and at the
�� ;� Mid-Continent Coal Basin Property for a three day period
,� ,
� approximately between September 24 and october 7, 1993; and
5. Filming requires the temporary construction of stage ,{i
sets, including a house/barn on the Filoha Meadows site and ��,;
� �t �a:,
:� a building facade on the Mid-COntinent site. Stages shall be ,�_,.

;� completely removed £rom the sites within approximately fifteen � �

1. All trucks, cars and trailers associated with the project ,r:�:;
sha1Z be parked and stored off public right-of-ways, on either +''
�, existing roads or in approved designated areas. ,�F'

,a 2. The applicants shall comply with County Noise Regulations, ' -,a�
�i unless a variance is granted by the Enviranmental Health ;`'
i Department. •#�'
' � 3. All areas affected by the activities conducted by, or under
the direction oz control of, the applicant shall be restored
to their pre-parmit condition at the conclusion of this event. `t�
Al1 sites shall be kept clear or trash and debris. tti
`� 4. Revegetation of all disturbed areas shall be completed as soon ,;yi��
as possible. Native grass mixtures shall be used as �`' .
appropriate, and should be revegetated prior to snow falls.
� `�, Disturbance to wetlands areas shou2d be avoided to the maximum
:v extent possible. A revegetation plan shall be submitted and
approved by staff prior to filming. The "plan" shall address
any wetland or riparian areas disturbed by set construction `
`� or film crews. The plan shall replace wetlands of equal value
H on at least a 1:1 basis. The zevegetation sha11 be guaranteed ;� '
� through a secured contract with a qua2ified wetland biologist a
----� which includes Pitkin County as a beneficiary. The contract
� Zanguage shall be approved by the county Attorney. The ,,
� revegetation effort shall kae substantially successful as
� demonstrated by adequate growth.

-� 5. All crews and disturbance sha11 be confined to areas of •
approved disturbance, as determined by the.Planning office.
6. Proof of access agreements shall be submitted to the Planning �
Office prior to use of private properties for access. !.
7. The applicant shall be responsible for a11 area maintenance. �r�� �,;

8. Prior to commencement of filming, the applicant sha12 provide

a letter of consent to the County from all property owners on g , i
�" whose property the applicant intends to film. 'r�

9. This temporary use permit is issued to Tall Tale to �'
accommodate the �ilminq of a motion picture. Filminq sha11 ��•j '
be staged at the Filoha Meadows site from approximately ,��

1 10. Any lighting shall be directed and focused so as to not �'"
, adversely affect residences in the vicinity of filminq. ;,��4

li. The activities of the applicant shall not generate debris,
excessive noises, smoke, odors, electrical interference, � ,�'
� i traffic, or congestion which will adversely or unreasonably
j affect surrounding residential operations.

� 12. The use of any privately owned property; including the �
location of any vehicles, equipment or materials within said
f"
i property, is not authorized without the expressed written N�
approval of the landowner. No generators or other noise "�''�
� producing equipment may be placed within 200 feet of private
' � property without Pirst obtaining written approval of all
landowners within said distance of the equipment. A copy of
vsaid landowner approval(s) shall be forwarded to Suzanne
Konchan, Planning Director, prior to the commencement of this
+ event.

� 13. All material representations made by the applicant in the ��k . .
application and in public meetings shall be adhered to and
� considered conditions of approval, unless otherwise amended .f,
by other conditions.

\ � 14. Prior to any use of food coloring or other material to "calor" �
•.� ` the fields for shooting, information on the material to be .
� used shall be submitted to the Planning Office and the
Division of Wildlife for approval. This shall include
chemiaal composition, application rates and amounts. !��
