Colorado Revised Statutes ("C.R.S."), Sectiqn 1-41-101, �l;�.` ' et. se ., authorizes county governments to submit lacal government matters arising under Section 20 of Article X of the State Constitution to the electorate at a local election to be held on November 2, 1993. �`r�.: 3. C.R.S., Section 29-2-103.5, shail be imposed on the sale of - tangible personal property at retail and the furnishing of services in Pitkin County as providec3 in C.R.S., Section 29-2-105 (1) (dj, as amended. The same property and services shall be taxed and the + � same items shall be exempt as provided for in the origina2 County :.,;r;�;•, sales tax resolution of October 7, 1968, and as amended by ,. Resolution dated September 7, 2972, Resolution 78-121, Resolution .. _ 83-29, Resolution 85-45, and Resolution 85-46. "��• �= .��,: - �F . b. An additional 1/23 use tax, as authorized by C.R.S., r� ; Section 29-2-103.5, shall be imposed for the privilege af using or ik t'.;�:, consuming in Pitkin County any constzuction and building materials x,;: purchased at retail and for the privilege of storing, using, or �L; � consuming in Pitkin County any motor and other vehicles, purchased � at retail on which registration is required. The same privileges �'3 f shall be taxed and the same items shall be exempt as provided for ;�'`YA the existing County use tax in Resolution 88-89 as amended by � = Resolution 88-94. The use tax shall be col.lected according to the `�'�? procedures established by Resolution 89-23 and as they may be amended by future resolutions. �. :a. '.' c. The effective date of the additional 1/2� sales and �' �; use tax shall be January 1, 1994, and the tax shall continue thereafter until repealed. The County Clerk shall notify the ��;� executive director of the department of revenue of the adoption of �";�•' the tax at least forty-five days prior to the effective date. d. The full proceeds of the additional 1/2% sales and �' use tax shall be retained by Pitkin County and credited to a � separate fund to be expended so2eZy for the purpose o£ financinq, `s `� constructing, operating or maintaining a mass transportation system � within the County pursuant to C.R.S., Section 29-2-103.8, and as �� further restricted by the terms specified in the ballot question, '4 � e. Subject to the provisions of the previous paragraph ,,, 3.d., all or any part of the revenue from the additional 1/2� sales � and use tax may be credited to the °Sales and Use Tax Capital `t � Improvement Fund," hereby created, which is to be used solely to -` } provide capital improvements. , �� f.
