BELOW: Pursuant to Pitkin County Resolution of June 5, 1955, as amended, a Public Hearing will be held to consider
an application filed with the said Boazd of Adjustment requesting authority for variance from the provisions of the
County Zoning Resolution.
All persons affected by the proposed variance are invited to appear and state their views, protests or
objections. If you cannot appear personally at such meeting, then you are urged to state your views by letter,
particularly if you have objection to such variance, as the Boazd of Adjustment will give serious consideration to the
opinions of surrounding property owners and others affected in deciding whether to grant or deny the request for
variance.

This variance request is about how our tapered stone exterior walls affect the F.A.R.
calculations and the aesthetic feelings of this house.
The proposed house sits on a lot of 1.53 acres. The historic and unusual "Peak Road
Easement" (30') not only cuts through the natural building site on the property, but
combined right-of-way with row reductions for Wright Road lowers the allowable F.A.R.
by 1022 square feet. (8,664 s.f. to 7,642 s.f.).
This F.A.R. reduction combined with the staff interpretation of our tapered stone veneer
demonstrates a hardship.
The "tapered stone interpretation F.A.R. reduction by staff is 190.75 square feet.
We ask this board to consider our tapered stone discussion and allow us to leave these
"help the house feel smaller" details. See attached Exhibit "C".
We have gone to great expense to allow our stone to taper from 1'6" at the base to 6"
at the cap. The house with seem less massive as you look up at it from Red Mountain
Pass and down Wright Road. See Exhibit "D".
We ask that you allow a "mid wall" interpretation to not reduce our F.A.R. by 190.75
square feet. The character of this house is greatly enhanced by this detail and to
penalize us for this seems against the spirit of the code.

Dyer opened the meeting by introducing the Boazd members present and by explaining that he
would be Acting Chairman for this meeting.
Case # 98-28 Ted Eck and Mary Wilson, Lots 5, 6, and 7 Elk Mountain Ranch, AKA 88 Elk
Mountain Drive
Dyer introduced the request for an 11 foot Front Yard Setback Variance where 30 feet is required
for this .685 acre lot in the AFR-10 zone district and a 37 foot Major Road Setback Variance
where 100 feet is required from the Highway 133 right-of--way, for the construction of an
addition to a single family residence.
Schaffner stated that Elk Mt. Subdivision is located south of Redstone. These 3 lots have been
combined and received 1041 approval. Subsequently, the building envelope was revised to allow
for this proposed addition. The addition will be to an existing house and will encroach into the
Front Yazd Setback and Major Road Setback.
Ted Eck, the applicant, was present to explain the addition to the house of a single gazage with a
2"' floor library and an improved entrance to make it a year round residence. They have placed it
out of view of the Highway and so that no trees will be removed.
No members of the public were present.
A motion was made by Cooper to approve the request as submitted due to down-zoning.
The motion was seconded by Rudnick and passed 4-0.
Case # 98-29 Alain Degraeve Lot 10-A, Block 3, Red Mountain Subdivision AKA 186 Wright

Dyer introduced the request fora 190.75 square foot increase in the allowed floor area where a
maximum of 7642 square feet is allowed for this 1.53 acre lot in the R-30 zone district for the
construction of a single family residence.
Schaffner explained that this lot is located on Red Mountain and received 1041 Hazazd Review
approval. A 30-foot road easement crosses the property and reduces the allowed floor azea. The
Land Use Code exempts 8" of veneer from floor area calculations. Anything beyond 8" counts
in floor azea. The applicant proposes a veneer that exceeds 8" at the bottom but then is reduced
as it scales the wall.
Ron Robertson, the applicant's representative, Alain Degraeve, the applicant and his pazents
were present. Robertson stated that the historic emergency road easement has reduced the
allowed floor area. The design of the tapered walls will actually make the house look smaller.
Rudnick suggested that if this azchitectural treatment is desired they could reduce the floor azea
of the house by 190.75 squaze feet so they would not need a variance.
No other members of the public were present.
A motion was made by Rudnick to deny the request.
The motion was seconded by Throm and failed 2-2. Cooper & Dyer approved/Throm & Rudnick
opposed.
A motion to table the application to the February 2, 1999 meeting, so that other options could be
pursued as it was cleaz that it would not pass with the boazd members in attendance, was made
by Dyer.
The motion was seconded by Cooper and passed 4-0.
Case #98-30, Meyer, L.L.C., 23655 Two Rivers Road, Basalt
A motion was made by Rudnick to table this application to the February 2, 1999 meeting because
a public notice sign was not posted by the applicant.
The motion was seconded by Cooper, passing 4-0.
Case # 98-31, Neal and Amy Beidleman, Ardmore Subdivision "Open Area", AKA 120
Ardmore Court, Aspen
Dyer introduced a request for vaziances from setback and floor azea requirements for the
construction of a detached residential gazage on this 2740 squaze foot parcel in the R-15 zone
district.
Schaffner stated the property in question is privately owned subdivision open azea. The previous
owner illegally built a garage within the setback of this open azea. The structure was red-tagged,
and then denied by the Boazd of Adjustment for the same vaziance request. Subsequently the
roof was removed. The current owners want to remove the existing fence and reconstruct the
gazage by adding a pitched roof to the remaining structure. In order to accomplish this they
would need setback and increased floor azea vaziances.
Amy Biedleman, applicant, and attorney Boots Ferguson were present.
Rosemary Bilcheck & Gordon MacAlpine, adjacent neighbors, were present to vehemently
object to the approval of the vaziance on the grounds of no hardship. They would like to see the
existing structure removed completely. Cooper stated that removal of the structure is not within
the Board's scope. Given that, Bilcheck and MacAlpine's preference is that it be left as it is.
Paul Nicoletti, a neighbor at 138 Ardmore, wants to see it visually improved.
Cooper inquired how the neighborhood's interest is served by leaving it as it is and stated that
based on two site visits, he supports the vaziance in spite of the neighbor's opposition.
A motion was made by Rudnick to table this application to a site visit on Wednesday, January
13, 1999 at 2:00 pm.
The motion was seconded by Throm, passing 4-0.

The motion was seconded by Rudnick, passing 4-0.
