1. Paul Hoffenberg, hereinafter "Applicant", has applied to the

hereinafter "Board", for approval of a caretaker dwelling unit ,���>
' within an approved outbuilding pursuant to Section 3-8.13(d) of the
Land Use Code.
`,� 2. The Applicant proposes to construct a caretaker unit within �

�y a garage, instead of attached to the primary residence, as approved

� 3. Pursuant to Code Section 18-7, the applicant proposes to amend
� condition number 9d of the Feinsinger Lat Split resolution to

hereby grant approval to the Hoffenberg caretaker dwelling unit

application and an amendment to condition #9d of Resolution No. 90- ��

outbuilding on Lot 1, and may be attached to the primary reaidence

� 2. Prior to issuance of a building permit for the caretaker unit, s`e
} domestic water supply for the unit shall be documented to the %e�'-: .
� satisfaction of the State Department af Water Resources and '� �' '

j 3. The following conditions requested by the Aspen/Pitkin County �;
Housing Authority (APCHA) shall be adhered .to by the ;�''
applicant: a

a. The applicant shall provide a deed restriction, as
•r stipulated in Section 3-8.13(a) of the Land Use Code, to
y the APCHA for approval. Upon approval by the APCHA, the
• � applicant shall record the deed with the Pitkin County
_ Clerk and Recorder's Office prior to issuance of a
`= building permit for the caretaker unit. "'

b. Prior to leasing the Caretaker Dwelling Unit (in the �;>;
,; event that it is leased), the applicant shall notify the =' �`
Housing Authority, and have the prospective tenant ���'� .
ys+ complete the required qualification forms and submit
' those to the Housing Authority for approval.
? c. If the unit is rented, the applicant shall provide to the +
� Housing Authority a copy of the executed lease at the t
�� time the unit is rented and upon every renewal of the
� lease term. �

-� 2. All material representations made by the applicant in the ��
application and during public meetings shall be adhered ;�.
