f � � � WHEREAS, Patrick Iienry, Jr. and Kristen Henry are the owners '"•�h
� � of that property described on Exhibit "A" attached hereto, and � �.

� =E WHEREAS, the Henry property has been used exclusively for
a. �. residential purposes for more than twenty (20) years, and
_ a �
� - WHEREAS, upon application of the Aspen Skiing Company, Pitkin
�N County has approved a Mastez Plan for Aspen Mountain and Buttermilk
� Mountain, and also, by Resolution No. # 84-138 created the AF-SKI '�r
� C .n Zone District, and r ���
o ,::),.•
�i •� WHEREAS, the Henry property, without the consent of and proper
`� �.-. notice of the owners thereof, was included in the Aspen Skiing
, � #y Company Master Plan and Rezoning actions, and
" WHEREAS, the Caunty attorney's office and the planning office !:
� � have determined that the rezoning was in error, and that the AF-SKI �
zone only applies properties primarily used for alpine and cross-
_� country skiing, and related activities.
= �� NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF PITKIN COUNTY, COLORADO.
� 1. The Board has determined that the real property described
�
' on Exhibit "A" attached hereto was erroneously included in the AF- '
SKI Zone District and the Aspen Mountain and Buttermilk Mountain
Master Plan.
2. Pitkin County P2anning Department is hereby instructed to �
process on its own initiative an ordinance for public hearing and •�+';.,,
final reading on Tuesday, January 25, 1994, correcting the legal � :�'
description of the AF-SKI zone district removing the Henry property �'t ,o'_:
described on Exhibit "A" from the AF-SKI zone district and re- � `
instating the previous zoning of AF-2, and correcting page 8 of the !'
County's official zoning maps accordingly, and further indicating "'
