2. The County has authority, pursuant to, inter alia, 1973 '7°`

C.R.S. 41-4-101 et seq., as amended, and the Pitkin County Code, f;; ?
Title IV, Airport Regulations, to regulate the use of the Airport �i�.. .
and to set, charge, collect and enforce rates, fees, and charges r.�.:��. . �
`' for the use thereof. � �

3. The County adopted Resolution #87-56A, its amended '
Airport rate-setting policy, on November 24, 1988. 'k`'"
4. . The County entered into a Letter of Intent with United
Express and Continental Express airlines in October and November s' '
of 1989, which along with the provisions of holdover Use and Lease
%� Agreements, dated September 14, 1981, that were not inconsistent
;; with the Letter of Intent constituted the legally-enforceable '`<;�;'s
; relatianship between the County and the airlines through December '^��''
31, 1992. The Letter oE Intent was extended through June 1, 1993, '
- � by mutual agreement of the County and the airlines, and airline
fees and charges for 1993 ware set in conformance with the Letter
' of Intent.
J 5. For 1994 the County has proposed the adoption and
� execution of an annual operating permit to define the operational
� and legal relationship between the County and the airlines. The
___� proposed operating permit includes essentially the same rate y
setting methodology as the Letter of Tntent_

� 6. The operating permit states that airline rent shall be
��� increased annually by the increase in the US Consumer Price Index,
,_:i resuZting in a 2.8% increase to $677,065 for 1994 as calculated in ,
Exhibit "A".
�` 7. The operating permit provides that aixline rates and
; ehaxges "be calculated on a residual basis . . . annually to produce ',�

8. The operating germit provides that airline rent may be ';��
increased annually on January 1 and airline landing fees may be
adjusted semiannually on January 1 and July 1 so that the Airport
breaks even on the residual basis described above. -�,;�;: '.

of $249,048 (or $.65 per 1,000 paunds based on estimated landing "��'�

10. The landing fee and estimated landing weights for 1994 4;,:��,
are contingent on the continuation throughout 1994 of the level of ,�
service and equipment provided by the airlines during 1993. Any ��
significant decrease in the level of service and equipment will ��'
`;? require a compensatory increase in the landing fee in order for the ��-,��
airport to break even and maintain a coverage ratio of 1.5. ' *�'�-

. Airport was reviewed in public session on October il, 1993, first
reading was held thereon on December 14, 1993, and a public hearing
was held thereon on December 21, 1993, with fina2 adoption on the �t"

= 12. Some projects have been delayed beyond the schedule in ;'y�=
� the approved capital improvement plan, but the airpoxt has 'f�''
� proceeded in good faith to complete the projects as expeditiousZy
- � and economically as possible as discussed in Exhibit "C".

� have been given the opportunity to comment on the airport's budget

� NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY

The land acquisition project was completed in June of 1993 with the i"t:�:`-
acquisition of 262 acres of land, of which 135 acres are identified �"�?. '`
as approach grotection for the airport, funded 90/l0 with the FAA. j';,:�::
Purchase included appraisals, surveys, and water rights. In �+:� '
i i,
addition to the Airport and FAA, the Pitkin County open Space Board �
and the Colorado Department of Transportation contributed to the
purchase of the property. �:±�,

RELOCATE STATS HIGBWAY 82:
� Essentially, the County's inability to move forward with the
highway relocation project has been due to the delays experienced
in acquiring the land. All engineering design for the new highway
was approved by the Colorado department of Highways and the Federal .,.
Aviation Administration in Spring, 1990. Additionally, both the `!.'*r'.=
CDOT and the FAA mutually agreed to deem the proj ect a "categorical ���`� .
exclusion" at that time, thus an environmental assessment was y
deemed unnecessary. The Pitkin county Planning and Zoning
Commission approved the project during the same time period. Now
�� that the land is in the possession of the County, the project is r
�; scheduled to be completed in 1994, subject to the availability of ' "
federal funds through the Airport Improvement Program and the
approval to enact passenger facility charges. ��
-�' COMPLETE TERMINAL:
� The only remaining item is the payment of water tap fees to the
City of Aspen. Final costs were determined in 1991 and a payment
� ` schedule implemented to pay the balance of the costs by the end of ,
�.
1994. A portion of the balance is budgeted for payment each year.
