The Contractor shall: , �;�;`•, :4� .i s. provide intake screening, erisis interventian and supervision i;� , . � o£ juveniles as described in the attached Bxhibit A. � '? b. provide the 3tate with monthly reparts outlining the servicea ��{�{': 1 i provided over the previous month. Said reports shall he mailed by the Contractor to the State on or before t,he 5th of �'f:'- , j the ensuing month. i j 2. The State agrees to pay the Contractor a sum not to exceed � $2,400.00 (Two Thousand Four Hundred Dollars and no centa) for i services provided during FY 93-94, payable upon presentation of F invoices from and certiPied by the Contractor. `:� ,�. j Paymenta will be made on a monthly basis. Requests for payment �`' - { ahall be made by the Contractor betHeen the first and fifth o£ the � following month. Payment will be made by the State upon the � receipt of a monthly invoice from the Contractor in the amount of $200.00, or 1/12th of the above agreed upon dollar figure.. .� l3. The Contractor will maintain confidentiality of client recorda in #�. I accordance with (CRS) 2973-24-201, et seq as it presentlq .exists or _ may subsequently be amended. � 4. The Contractor ahali perform its duties hereunder as an independent .�' Contractor and not as an emgloyee of the State. Neither the `� Contractor nor any agent or employee of the Contractor shall be or �: � shall be deemed to be an agent or employee of the State. The . Contractor shall pay when due all required employment taxes and income tax withholding, shall provide and keep in force worker's � compensation (and show proof of such insurance) and unemployment compensation insurance in the amounts required by law, and shall be �'�t solely responsible for the acts of the Contractor, its employees and agents. The Contractor shQll maintain in full force and effect at a11 times during the course of this agreement Comprehensive General Liability i''�;.:r,� . Tnaurance written on an occurrence basis, with a minimum of '. $600,000.00 combined single limit for bodily injury and property z ' dQmage arising out of any sing2e occurrence. Any aggregate limit �;�' will not be less than $1 million. The Contractor shall f�rnish the �.;`, • } State with Nritten certification of the existence of such liability 4 i insurance and a copy of the policy endorsement naming the State of t:?:�.`:�'_ Colorado as additional insured, prior to finalization of agreement "'^ ' ?:;, ::'.. � provisions. If the State approves in writing the alternative use � of "claims made" insurance for Comprehensive General Liability, the �•.~:;.^" � � Contractor also agrees to maintain beyond the agreement term such ,, .` insurance as will cover incidents which �ccurred during the '� � j agreement period, inel.uding but not limited to continued ; maintenance of "claims made" or "tail" policies for the applicable 4� , statute of limitations. To the extent suthorized by law, the Contractor shall indemnify, �:. save and hold harmless the State, its employees and agents, against �_ • j any and all claims, damages, liability and court awerds including `� � costs, expenses, and attorney fees incurred as a result of any act '. or omission by the Coqtractor, or its employees, agents, �, � subcontractors, or assignees pursuant .to the terms of thia � agreement. - i � 7. Either the Contractor or the State shall hsve the right to � � � terminate this Letter of Agreement at any time during the term of agreement by giving the other party thirty (30) days written '�`.�_ notice. If notice is given, this Letter of Agreement shall ; terminate on the expiration of the thirty (30) days, and the � liabilii:y of the parties herein for further performance on the j terms of this Letter of Agreement shall cease, but the parties � shall not be released from the duty to perform their obligations up - j to the date af the termination. � • '� 8. The State of Colorado with regard to personal servicea contracts � (Purchase Order/Letter of Agreement) is operating under a stay oi a court order that may affect our ability to continue the use of '� the services being called for in this contract (Purchase ° ' Order/Letter of Agreement). Sho�1d this stay be lifted or a lower I court ruling upheld by the Couri: of Appeals, the State may be , � forced to terminate this Agreement. While at the present time it is our intention to pursue to completion the conditions of this Agreement, such court ruling may require the State to terminate -; this contract (Purchase Order/Letter of Agreement) effective i immediately upon receipt of notice. This process i�corporates the use of a criteria set by the � Chief Judge of the District Court and the compiling of information on prior arrests and court history. i ' C�risis Intervention - be avaiiable to act as facilitator and/or mediator in crisis situations concerning youth, parents, law ';' ' 4 enforcement, etc.; when appropriate, will make referrals to Sooial � Services, Mental Health or other appropriate agencies. • i JO �SC$,�,gTION F,0,�2 THE INTAKE/SCREENINCa AND CRISI3 INTB�V$NTION STAFF � 1. The intake worker will be supervised by the Pitkin County Sheriff's Department, subject to the personnel rules of the i Pitkin County Sheriff's Department. Assistance and monitoring _._ will be provided by the Division of Youth Services Western Region � r Intake Coordinator. i ., j 2. Will screen all youth referred to secure detention and/or adult �; `� � jail facility by law enforcement, courts, probation departments, � t social services, and will advocate for the youth to ensure that i the youth is referred to the most appropriate service(s) � availab2e to meet his/her immediate needs. j i3. PSaintain a reportin$ system to include all information on youth , q� held or referred to alternative placement. �� 6. For youth who meet the criteria for non-secure alternatives, the f intake team will refer youth for home detention services if agpropriate, and/or identify and monitor commuaity service � I progrsms available for traffzc sentenced youth. � .
