Recitals
! � 1. WHEREAS, on March 8, 1993, the Board of County Commissioners
(hereinafter "Board") directed staff to prepare a code amendment
revising the annual submission dates for Growth Management .
I applications and amending the resident generation tables of the
Land Use Code to be consistent with the Affordable Housing
� Guidelines.
� � 2. NHEREAB, on March 16, 1993, the Pitkin County Planning and
� '�;H� Y Zoning Commission (hereinafter "Commission") reviewed said code
( amendments and recommended approval to the Board.
� 3. WHEREAB, the amendments will apply to the 1993 competition.

NOW, THEREFO� BE IT ORDAINED by the Board of County
��h°�' Commissioners of Pitkin County, Colorado, that it hereby approves
`� { amendments to the Pitkin County Land Use Code, by amending the
� I followinq Land Use Code Sections as follows:
� 1. Amend Section 5-510.5(a) (1) , as follows: ��
. "(1) Complete applications containing the following information '
shall be filed with the County Planning Office on or before ?'�"

"(b] The Planning Office shall evaluate all development allotment �` �
applications, reject those that are ineligible under Section
5-510.4(b), and present its recommendations to the Pitkin �
County Planning and Zoning Commission. The Planning and �:�'.-
. Zoning Commission shall review all applications, taking into i-
� consideration the following criteria and point schedule with
' respect to the Metro Area (Section 5-510.5(b) (1)) and the Non- � .
�i Metro Area (Section 5-510. (b) (2))."

4. Amend 5-510.5(b) (5), as follows:
� °(5) Having received the Commission's report, the Board shall i
entertain any complaints by applicants that the Commission has
abused its discretion, exceeded its authority, . or denied �
procedural due process in its processing of applications under
this growth management quota system. Any challenges must be
• � filed with the Planning office within fourteen (14) days of
�`�t,, the date on which the Commission did forward its ranking of
projects to the Board of County Commissioners. The Board, on ��
hearing such appeals, may affirm the action of the Commission, �
remand the application to the Commission for further
consideration, change the number of points awarded to any
applicant, or take any other action reasonably calculated to �
_..___;,_..� correct the error complained of.
;� Subsequent to the conclusion of all such hearings, the Board

i moderate- or middle-income housing. Any applicattt wishing to +�' . '

receive points under this Section shall specify in the application

project, and the method (as identified in Section 5-300.4) by which
� the applicant will provide low-, moderate- or middle- income
housing. Employee Dwelling Units as described and approved
�, .�� pursuant to 3-8.13 shall not be considered to satisfy the ;; �
`` provisions of this subsection. In order to establish criteria to
. determine which proposals constitute the type of units which will ':� 'r�
help alleviate the critical shortage of affordable housing, the
